II. PROCEDURE FOR AWARDING THE CONTRACT

1. The procedure is conducted as an unrestricted tender in accordance with art. 132-139 of the Act of 29 January 2004 on Public Procurement (Journal of Laws of 2026, item 793, as amended), hereinafter referred to as the Pzp Act, for a contract estimated value equal to or exceeding the EU thresholds (as specified in the annex to the notice of the President of the Public Procurement Office). The Specification of the Contract Terms, hereinafter referred to as "SWZ", will be referred to in the following text.

The contracting authority intends to use the so-called reverse procedure, as mentioned in art. 139 para. 1 of the Pzp Act, which involves first examining and evaluating the offers, and then qualifying the contractor whose offer was the highest rated, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure.

4. The provisions of the Pzp Act and regulations issued on the basis of this Act apply directly to this procedure. In all regulated and unregulated matters in this SWZ, the provisions of these acts apply.

5. The contracting authority does not envisage an electronic auction.

6. The contracting authority does not envisage the submission of an offer in the form of electronic catalogues.

7. The contracting authority does not conduct a procedure for the conclusion of a framework agreement.

8. The contracting authority does not reserve the possibility of applying for a contract exclusively by contractors, as mentioned in art. 94 of the Pzp Act.

9. The contracting authority does not envisage the reimbursement of the costs of participating in the procedure.

10. The contracting authority does not envisage settlement in foreign currencies.

11. In accordance with the provisions of art. 95 para. 1 of the Pzp Act, the contracting authority requires the contractor or subcontractor to employ, on the basis of an employment relationship in accordance with the provisions of the Act of 26 June 1974 on the Labour Code (i.e. Journal of Laws of 2025, item 277, as amended), persons performing activities related to the performance of works, i.e. persons operating communal installations, and in particular, persons operating a certified industrial scale, persons performing sorting activities at the sorting conveyor.

12. Detailed requirements regarding the implementation and enforcement of the employment requirement on the basis of an employment relationship have been specified in the Model Contract, which is Annex No. 2 to the SWZ.

13. The contracting authority does not specify additional requirements related to the employment of persons, as mentioned in art. 96 para. 2 point 2 of the Pzp Act.

14. The contracting authority has not divided the contract into parts for individual waste fractions, as such a division would require the coordination of a significant number of contractors, which could generate significant and unjustified additional costs for the contracting authority.

15. The contracting authority does not envisage the contractor carrying out a local inspection.

III. DEFINITION OF THE CONTRACT

1. The subject of the contract is a comprehensive service for the management of municipal waste, consisting of: 1) accepting municipal waste, specified by type in the place of acceptance of municipal waste indicated and provided by the contractor, from the municipal waste collection operator, in a manner consistent with the law and the requirements arising from the contract documents, 2) processing the accepted municipal waste in recovery (R) and/or neutralisation (D) and/or collection/storage processes, in the place of management of municipal waste indicated and provided by the contractor, in a manner consistent with the law and the requirements arising from the contract documents, 3) fulfilling reporting-information obligations, 4) fulfilling obligations guaranteeing the contracting authority the possibility of realising control-verification rights, 5) fulfilling services and obligations related to the services expressed above in points 1-4 - hereinafter collectively referred to as the "municipal waste management service".

3. The contracting authority recommends referring to the above procedure number in all correspondence relating to the Procedure.

IV. DESCRIPTION OF THE CONTRACT

1. The subject of the contract has been described in: 1) Description of the Subject of the Contract (OPZ), which is Annex No. 1 to the SWZ, 2) Model Contract, which is Annex No. 2 to the SWZ, 3) Offer Form, which is Annex No. 3 to the SWZ.

3. Note! Whenever a trademark, patent or origin, source or special process that characterises the products or services provided by a specific contractor is indicated in the SWZ, it should be assumed that the words "or equivalent" are placed after each name, i.e. that the built-in materials, devices, etc. will have (be characterised by) all the parameters not worse than those described in the aforementioned documents. Furthermore, whenever the contracting authority in the SWZ describes the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems, as mentioned in art. 101 para. 1 point 2 and para. 3 of the Pzp Act, it should be assumed that each such reference is accompanied by the words "or equivalent", i.e. that the built-in materials, devices, manner of execution, etc. will have (be characterised by) all the parameters not worse than those described in the aforementioned documents.
