2. PROCEDURE FOR AWARDING THE CONTRACT

2.1. The procedure is conducted as an open tender in accordance with the provisions of the Act of 11 September 2019 - Public Procurement Law (i.e. Dz. U. z 2026 r. poz. 793 with later amendments; hereinafter: PZP) and the executive acts to PZP.

2.2. The procedure is conducted in accordance with the rules provided for classical contracts with a value equal to or higher than the amounts specified in the announcement by the President of the Public Procurement Office issued pursuant to Article 3(2) of PZP.

2.3. The procedure will be conducted in accordance with the rules provided for the so-called "reverse order of evaluation of offers", as mentioned in Article 139 of PZP. According to the aforementioned provisions, the Contracting Authority will first conduct an examination and evaluation of the offers, and then qualify the Contractor, whose offer was highest evaluated, in terms of the grounds for exclusion and the fulfillment of the conditions for participation in the procedure.

3. DEFINITIONS

Whenever the following terms are mentioned in this SWZ:

a) PZP - this shall mean the Act of 11 September 2019 - Public Procurement Law (i.e. Dz. U. z 2026 r. poz. 793 with later amendments),

b) Directive 2014/24/EU – this shall mean Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement, repealing Directive 2004/18/EC (OJ EU L. 2014 r. Nr 94, str. 65 with later amendments),

c) contract - this shall mean the public contract to which this SWZ relates,

d) procedure - this shall mean the procedure for awarding the contract,

e) Contracting Authority – this shall mean the Contracting Authorities listed in Section 1, Part I of SWZ,

f) working day - this shall mean a day that is not a statutory holiday or a Saturday,

g) price – this shall mean the price in the sense of Article 3(1) point 1 and Article 3(2) of the Act of 9 May 2014 on informing about the prices of goods and services (i.e. Dz. U. z 2023 r. poz. 168), even if it is paid to a person who is not an entrepreneur,

h) Contractor – this shall mean a natural person, legal person or organizational unit without legal personality, which offers on the market the execution of construction works or a construction object, the supply of products or the provision of services or applies for the award of a contract, submitted an offer or concluded a contract for a public contract,

i) consortium – this shall mean Contractors jointly applying for the award of a contract,

j) SWZ, specification – this shall mean this specification of the contract conditions,

k) single document/JEDZ (Jednolity Europejski Dokument Zamówienia) – this shall mean a declaration made on the form of the single European order document, prepared in accordance with the standard form template specified in the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form of the single European order document,

l) qualified electronic signature - a signature issued by a qualified trust service provider being a subject providing certification services and based on a qualified electronic signature certificate. The electronic signature must meet the security requirements specified in the Act of 5 September 2016 on trust services and electronic identification (i.e. Dz. U. z 2024 r. poz. 1725) and Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (OJ EU L. 2014 r. Nr 257, str. 73 with later amendments; Regulation eIDAS),

m) offer – this shall mean the Offer Form submitted in electronic form together with the remaining documents required in the procedure documentation, meeting the provision of Article 78 (1) § 1 of the Civil Code of 23 April 1964 (i.e. Dz. U. z 2026 r. poz. 795) (c.c.) and Article 66 §1 c.c. in connection with Article 8(1) and Article 63(1) and Article 218(2) of PZP,

n) partial offer - this shall mean an offer providing, in accordance with the contract documents, for the execution of part of the contract;

o) subjective evidential means - this shall mean means serving to confirm the absence of grounds for exclusion or the fulfillment of the conditions for participation in the procedure, with the exception of JEDZ,

4. DESCRIPTION OF THE CONTRACT SUBJECT

4.1. The subject of the contract is: comprehensive provision of a service related to the acceptance and management of municipal waste, entitled "Management of municipal waste from uninhabited properties in the area of the Municipality of Środa Wielkopolska in 2027".
