LE POUVOIR ADJUDICATEUR: SAC AU FIL DES DEUX FLEUVES HANDLING ON BEHALF AND FOR THE ACCOUNT OF: DEUX FLEUVES RHONE HABITAT, DEUX FLEUVES LOIRE HABITAT AND DEUX FLEUVES SENIOR & AUTONOMIE

The tender has the purpose of entrusting an insurance professional with the management of the Property Damage policy, the placement of 100% of the risks, and a consulting and support mission. In accordance with the Insurance Code, the exercise of the profession is strictly reserved for insurance companies (administrative approval, article L.320-2 of the Code of Mutualities and L.321-1 of the Insurance Code) and/or insurance intermediaries (registration certificate with ORIAS, article R.512-1 of the Insurance Code). The present consultation constitutes an order for study and releases the co-insurers from their obligations vis-à-vis the current applicant. No insurer or intermediary can claim any exclusivity or priority based solely on the principle of the seniority of the insurers' approach, which would be considered contrary to free competition. The consultation is carried out by Negotiated Procedure in accordance with Articles L. 2124-3, R.2124-3, R2161-12 to R2161-20 of the Public Procurement Code. The contract will be awarded with prior negotiation due to particular legal and financial circumstances in accordance with Article R.2124-3, 4° of the Public Procurement Code. This procedure is divided into two successive phases: Phase 1: the open call for competition, which aims to establish the list of candidates admitted to submit an offer. Phase 2: the candidates admitted to submit an offer are invited to submit their offer. The consultation will result in an ordinary contract. The present contract is concluded with a single economic operator. At the end of the open call for competition, the maximum number of candidates selected to submit an offer is 6 candidates maximum. However, if the number of candidates meeting the selection criteria for tenders is less than 6 (six), SAC AU FIL DES DEUX FLEUVES may continue the procedure with the only candidate(s) selected.
