Due to the confidential nature of the information in the Subject of the Order Description, the OPZ will be provided exclusively to the Contractors who will be invited to the second stage of submitting offers, by sending the information to the e-mail address indicated by the Contractor. 1. The Contracting Authority will exclude from the tender procedure the contractors in respect of whom any of the circumstances indicated in art. 108 para. 1 points 1-6 of the Pzp (mandatory grounds for exclusion): 1.1 Being a natural person who has been finally convicted of a criminal offence: a) participation in an organised criminal group or association with the aim of committing a criminal offence or a tax offence, as referred to in art. 258 of the Penal Code - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act; b) human trafficking, as referred to in art. 189a of the Penal Code - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act; c) as referred to in art. 228-230a, art. 250a of the Penal Code, in art. 46-48 of the Act of 25 June 2010 on sport (Dz. U. of 2023 item 2048 and of 2024 item 1166) or in art. 54 para. 1-4 of the Act of 12 May 2011 on the reimbursement of medicines, special foodstuffs for medical purposes and medical devices (Dz. U. of 2024 item 930) - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act; d) financing a criminal offence of a terrorist nature, as referred to in art. 165a of the Penal Code, or a criminal offence of impeding or obstructing the determination of the criminal origin of money or concealing its origin, as referred to in art. 299 of the Penal Code - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act; e) of a terrorist nature, as referred to in art. 115 § 20 of the Penal Code, or having the aim of committing this criminal offence - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act; f) entrusting a minor foreigner with work, as referred to in art. 9 para. 2 of the Act of 15 June 2012 on the consequences of entrusting work to foreigners staying in breach of the regulations on the territory of the Republic of Poland (Dz. U. of 2021 item 1745) - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act; g) against economic turnover, as referred to in art. 296-307 of the Penal Code, the criminal offence of fraud, as referred to in art. 286 of the Penal Code, the criminal offence against the credibility of documents, as referred to in art. 270-277d of the Penal Code, or a tax criminal offence - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act; h) as referred to in art. 9 para. 1 and 3 or art. 10 of the Act of 15 June 2012 on the consequences of entrusting work to foreigners staying in breach of the regulations on the territory of the Republic of Poland - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act - or for a corresponding prohibited act defined in the provisions of foreign law; 1.2 If a member of its governing or supervisory body, a partner in a general or limited partnership, a limited partner in a limited liability company or a proxy has been finally convicted of a criminal offence, as referred to above in point 1.1. Information - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 1 lit. a) of the Act 1.3 In respect of whom a final court judgment or final administrative decision has been issued on the failure to pay taxes, fees or social or health insurance contributions, unless the contractor has made the payment of the due taxes, fees or social or health insurance contributions together with interest or fines or has concluded a binding agreement on the repayment of these liabilities - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 3 of the Act 1.4 In respect of whom a final prohibition on applying for public contracts has been issued - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 4 of the Act 1.5 If the contracting authority can establish, on the basis of reliable indications, that the contractor has concluded an agreement with other contractors with the aim of distorting competition, in particular if, belonging to the same capital group within the meaning of the Act of 16 February 2007 on the protection of competition and consumers, they have submitted separate offers, partial offers or applications for admission to the procedure, unless they prove that they have prepared these offers or applications independently of each other - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 5 of the Act 1.6 If, in the cases referred to in art. 85 para. 1, there has been a distortion of competition resulting from the earlier involvement of that contractor or entity which belongs to the same capital group with the contractor within the meaning of the Act of 16 February 2007 on the protection of competition and consumers, unless the distortion of competition caused by this can be eliminated in a different way than by excluding the contractor from participation in the tender procedure - on the basis of art. 405 para. 1 in conjunction with art. 108 para. 1 point 6 of the Act.
