Poland – Planting and maintenance services of green areas – Zagospodarowanie terenów zielonych w ramach projektu pod nazwą: „Ochrona bioróżnorodności, siedlisk zwierząt i gatunków roślin na terenie Parku Miejskiego w Opolu Lubelskim”

The subject of the contract is the implementation of the task entitled: "Green area management as part of the project entitled: 'Protection of biodiversity, animal habitats and plant species in the Municipal Park in Opole Lubelskie'". The task is co-financed from the funds of the European Funds for Lublin 2021-2027, under Action 3.11: Biodiversity Protection as part of Integrated Municipal Territorial Investments of Functional Areas. 2. The subject of the contract is not divided into parts. The reasons for not dividing the contract into parts are provided in the further part of the SWZ. 3. The scope of the contract concerns the area of the municipal park, which is located on the plot with the cadastral number 421 in Opole Lubelskie, district 03 city of Opole Lubelskie. The investment area is subject to the provisions of the local spatial development plan of the city of Opole Lubelskie, approved by resolution No. X/92/04 RM in Opole Lubelskie of 27 January 2004 (Official Journal of the Lublin Voivodeship No. 448 item 985 of 17 March 2004). Plot No. 421 is part of the park and palace complex in Niezdów. The entire area of the palace and park complex in Niezdów is under the protection of the Voivodeship Conservator of Monuments. The object is entered in the register of monuments of the Lublin voivodeship under No. A/447, including greenery within the scope of the entry. 4. The contract includes, among others: 1) purchase of plant material for planting according to the attached greenery project and the scope of work, including: a) trees in the amount of 124 units; b) shrubs in the amount of 803 units; c) ground cover shrubs in the amount of 5428 units; d) perennials in the amount of 6411 units; e) perennial mix 2335 units; f) aquatic plants in the amount of 2585 units. g) climbers in the amount of 43 units. 2) transplanting 6 units of trees and 150 units of shrubs, 3) digging planting holes proportional to the size of the planted material, 4) complete filling of the holes with fertile soil with hydrogel, 5) preparation of the area for planting, 6) planting of trees and shrubs, perennials, aquatic plants, climbers, 7) watering of trees and shrubs, 8) stabilization of trees in the soil – tree anchoring system using root ball anchors anchored in the soil 9) installation of root ball ventilation systems for trees – drainage pipe, 10) wrapping the trunks of planted trees with jute fabric tape, 11) installation of vertical screens for trees made of plastic, 12) making mounds around trees and covering them with bark, 13) pruning of shrubs, ground cover shrubs, perennials and climbers, 14) laying out lawns, meadows; 15) purchase and installation of small architecture in the form of: hotels for insects, educational wooden signs, birdhouses, bat houses, delivery and installation of platforms and baskets for building nests for water birds, 16) tidying up the area after completion of the works; 17) preparation of the post-construction inventory together with the post-construction list in terms of quantity, species and characteristic parameters; 18) The Contractor ensures that, if necessary, an authorized archaeologist will be provided to implement this contract. 19) ensuring the maintenance of the plantings carried out as part of the investment for a period of at least 12 months. 5. NOTE: The Purchaser informs that the Contractor will implement the subject of the contract on the basis of the design documentation for the revitalization of the municipal park stage II, approved by the building permit No. AB.6740.5.153.2021 of 28.12.2021 together with the changes resulting from the alternative revitalization park project approved by the alternative permit No. AB.6740.5.67.2024 of 28.08.2024. The alternative project was prepared for the needs of the implementation of the project entitled: Protection of biodiversity, animal habitats and plant species in the Municipal Park in Opole Lubelskie. 6. It is not envisaged to close the park during the works, but periodic restrictions on the park's activities are allowed with the consent of the Purchaser after presenting the justification for the restriction. During the performance of the works, the park area should be marked and secured. 7. The detailed material scope of the contract to be performed is presented in this SWZ, in the attached design documentation regarding the revitalization of the park stage II together with the alternative project – attachments No. 8 to the SWZ. 9. The Purchaser informs that where the Purchaser has described the subject of the contract by reference to standards, European Technical Assessments, approvals, technical specifications and technical reference systems, equivalent solutions are allowed. The Purchaser informs that where in the SWZ and its attachments the subject of the contract is described by indicating trademarks, patents or origin, source or a specific process that characterizes the products supplied by a specific Contractor, which could lead to the privileging or elimination of certain Contractors or products, the Purchaser allows an equivalent solution provided that they have no worse properties and quality. A Contractor who refers to equivalent solutions described by the Purchaser is obliged to prove in their offer that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 10. The Purchaser does not allow the possibility of submitting partial offers. The lack of division of the contract into parts results from the following conditions: Division of the contract would pose excessive technical difficulties, excessive costs and would not guarantee the intended natural and ecological effects. 11. The Purchaser does not allow the submission of variant offers. 12. The Purchaser does not envisage the conclusion of a framework agreement. 13. The Purchaser does not envisage the selection of the most advantageous offer with the use of an electronic auction and the awarding of repeated contracts. 14. The Purchaser does not envisage the possibility of awarding contracts, as referred to in Article 214(1)(7) and (8) of the Act.
