Description

The subject of the contract is: Supply of relays and electrical and electronic safety devices for the Departments of Polska Grupa Górnicza S.A. – group number 317-1. 2. CPV Code: 31700000-3 3. The detailed description of the subject of the contract as well as the legal requirements and technical parameters are specified in Annex No. 1 to this SWZ. The quantitative scope of the subject of the contract is an estimated scope determined by the Contracting Authority with due care. The Contracting Authority, despite exercising due care, does not guarantee the full implementation of the contract due to the nature of the activity conducted. 4. In order to confirm that the offered service is in accordance with the requirements of the Contracting Authority, it is necessary to submit, together with the offer, the relevant evidentiary means. 5. The Contracting Authority does not allow the possibility of submitting variant offers. 6. The Contracting Authority allows the possibility of offering more than one product (products from different manufacturers) within the scope of one position of the offer form. If the contractor offers more than one product (products from different manufacturers) in a given position of the offer form, it is required: a) that each offered product meets the requirements specified in the SWZ, b) that, together with the offer, relevant evidentiary means are submitted regarding all the offered products. An offer in which products from different manufacturers have been offered within the scope of one position of the offer form is considered to be in accordance with the requirements of the SWZ, provided that all the offered products in the given position of the offer form meet the requirements. In the event that even one of the offered products does not meet the requirements, the offer is subject to rejection under art. 226(1)(5) of the Pzp Act. 7. The Contracting Authority reserves the right to change the quantity of the ordered goods within the scope of individual assortment positions and to place orders according to actual needs, with the reservation that the total value of the deliveries will not exceed the value of the contract. 8. The procedure for awarding a sectoral contract is conducted in the form of an open tender, in accordance with the provisions of the Act of 11 September 2019 (Dz.U. poz. 2019 ze zm.), hereinafter referred to as the Pzp Act. 9. The procedure is conducted in the Polish language. 10. The information obligation arising from Article 13 and 14 of the Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L.2016.119.1 of 4 May 2016) (hereinafter referred to as the "RODO") has been fulfilled on the website of PGG S.A. in the RODO tab, in the annex "Contractors/Contractors' Employees". In the case of processing personal data for a purpose related to the procedure for awarding a public contract, the Contracting Authority has fulfilled the information obligation in the Buyer's Profile on the website of Polska Grupa Górnicza in the "PZP Information Obligation" tab. 11. Additionally, the Contracting Authority informs that a) the exercise by a person, whose personal data are concerned, of the right to rectification or completion, referred to in Article 16 of the RODO, cannot result in a change in the outcome of the procedure for awarding a contract or a change in the provisions of the contract for a public contract in a scope inconsistent with the Act. b) in the procedure for awarding a contract, the submission of a request to restrict processing, referred to in Article 18(1) of the RODO, does not limit the processing of personal data until the completion of that procedure. 12. The Contracting Authority allows the possibility of submitting partial offers for individual parts of the contract (tasks) specified in Annex No. 2 to the SWZ. The submitted offer must cover the entire scope of the subject matter and quantity of the part of the contract. The number of parts of the contract (tasks) is: 13. In the case of the contract part (task) No. 1-12, the submitted offer must cover the entire scope of the subject matter and quantity of the part of the contract (task). In the case of the contract part (task) No. 13, the Contracting Authority allows the possibility of submitting partial offers for individual assortment positions (spare parts specified in Annex No. 2 to the SWZ) within the scope of the task. The submitted offer must cover the entire quantitative scope of the given position. The number of assortment positions in task No. 13 is: 30. 13. The type and quantity of tasks are specified in detail in the Offer Form, which is Annex No. 2 to the SWZ. 14. The Contracting Authority envisages the possibility of submitting an offer by one Contractor for one or more parts of the contract (tasks/positions). 15. The offer, together with the annexes and the JEDZ, must be prepared in electronic form and signed with a qualified electronic signature, under pain of invalidity.
