The procedure for awarding the subject public contract is conducted in accordance with the provisions of the Act of 11 September 2019 on Public Procurement – hereinafter referred to as the “Act on Public Procurement” – and the implementing regulations issued on its basis, in particular the Ordinance of the Minister of Development, Labour and Technology of 23 December 2020 on the subject of personal evidentiary means and other documents or declarations that the contracting authority may request from the contractor – hereinafter referred to as the “MR Ordinance” – in the procedure of an unrestricted tender. 2 In accordance with Article 139 of the Act on Public Procurement, the Contracting Authority first conducts an examination and evaluation of the tenders, and then conducts a subjective qualification of the contractor whose tender is most highly evaluated, in terms of the absence of grounds for exclusion from the procedure and the fulfilment of the conditions for participation. 3 Pursuant to Article 257 of the Act on Public Procurement, the Contracting Authority reserves the right to invalidate the subject procedure if the funds that the Contracting Authority intended to allocate for the financing of the whole or part of the subject contract are not granted to it. In the case of invalidation on the basis of the above grounds, the Contractor is not entitled to a refund of the costs of participating in the procedure. 4. The Contractor remains bound by the tender submitted until 26.10.2026. The period of the tender's binding begins with the expiry of the tender submission deadline. 5. Contractors who meet the following conditions of participation in the procedure may participate in the procedure: in terms of technical or professional capacity: a) relating to experience in performing similar services. The Contractor must demonstrate the performance – not earlier than in the period of the last five (5) years before the expiry of the tender submission deadline in the procedure, and if the period of conducting business is shorter – in this period, of one (1) service (contract) covering the scope of modernisation of the ASTKZ system for an amount of 500,000.00 zł gross within one contract. NOTE: In order to confirm the fulfilment of the condition specified in point 7.3.4 lit. a SWZ, the Contractor may refer to a contract (contract/task) which has not yet been completed but covers the scope envisaged in the condition, if it proves that by the expiry of the tender submission deadline the service indicated in the condition has been completed and accepted. NOTE: The Contracting Authority considers work involving the replacement, installation and configuration of elements of the existing automatic barrier control system to be modernisation. 6. The Contracting Authority requires the Contractor to conduct a local inspection. a) each of the Contractors wishing to participate in the local inspection is obliged to inform the Contracting Authority in writing in advance of their intention to participate in the local inspection. The information should be sent to the representatives of the Contracting Authority Mr Grzegorz Wesołowski e-mail: [email protected] or Mr Patryk Majerski e-mail: [email protected], specifying the date and time of arrival, b) it is recommended that the Contractor prepares, inter alia, photographic documentation of the existing site condition from the site visit conducted, c) a protocol (signed by the representatives of the Contractor and the Contracting Authority) will be prepared in 2 identical copies (1st for the Contracting Authority, 2nd for the Contractor) from the site visit conducted. It is recommended to attach a copy of the protocol to the tender, as confirmation of the site visit conducted. The template for the protocol is Annex No. 11 to the SWZ. The Contracting Authority will reject a tender submitted without a local inspection. d) the written information referred to in point a) above should be sent to the Contracting Authority no later than 5 calendar days before the proposed date of the inspection, with the obligation to conduct the inspection before the expiry of the tender submission deadline.
