The subject of the contract is the supply of computer equipment, in accordance with the rules set out in the SWZ, including the form describing the subject of the contract for the given Part and in the draft contractual clauses relating to the given Part. The subject of the contract has been divided into three (3) parts: a) Part I – supply of standard portable computers with monitors; b) Part II – supply of high-performance portable computers with monitors, c) Part III – supply of high-performance desktop computers with monitors, with the possibility of submitting partial offers. Note! The Contracting Authority provides for the right of option in each Part of the contract. 1) Part I In addition to the guaranteed contract in Part I, which includes the supply of 73 units of standard portable computers and 73 units of monitors, the Contracting Authority reserves the right to exercise the option contract. The exercise of the option right will involve the delivery of equipment in the number indicated by the Contracting Authority, i.e. a maximum of 17 units of standard portable computers and a maximum of 17 units of monitors. The description of the equipment covered by the option right is identical to the description of the equipment covered by the guaranteed contract. 2) Part II In addition to the guaranteed contract in Part II, which includes the supply of 20 units of high-performance portable computers and 20 units of monitors, the Contracting Authority reserves the right to exercise the option contract. The exercise of the option right will involve the delivery of equipment in the number indicated by the Contracting Authority, i.e. a maximum of 5 units of high-performance portable computers and a maximum of 5 units of monitors. The description of the equipment covered by the option right is identical to the description of the equipment covered by the guaranteed contract. 3) Part III In addition to the guaranteed contract in Part III, which includes the supply of 8 units of high-performance desktop computers and 8 units of monitors, the Contracting Authority reserves the right to exercise the option contract. The exercise of the option right will involve the delivery of equipment in the number indicated by the Contracting Authority, i.e. a maximum of 4 units of high-performance desktop computers and a maximum of 4 units of monitors. The description of the equipment covered by the option right is identical to the description of the equipment covered by the guaranteed contract. The Contractor, by submitting an offer, undertakes to carry out both the guaranteed contract and the option contract, where the exercise of the option right will depend on the decision of the Contracting Authority (in particular, on the Contracting Authority having the necessary financial resources). The Contractor has no claims against the Contracting Authority in the event that the Contracting Authority does not exercise the option right or exercises it to a limited extent. » The subject of the contract offered and delivered as part of the given Part must meet the requirements specified in the SWZ. The detailed description of the subject of the contract is contained in the forms describing the subject of the contract for the given Part, which are an integral part of the SWZ. » The contract will be executed on the terms set out in the draft contractual clauses (appropriately for the given Part), which are an integral part of the SWZ. » The SWZ, including the description of the subject of the contract for each Part, specifies the quality requirements referred to in Article 246(2) of the pzp. » The term "manufacturer" used in the SWZ shall also be understood to mean "manufacturer's representative". The term "manufacturer's representative" shall mean a party formally authorised by the manufacturer to perform certain acts on behalf of the manufacturer. » The Contractor must provide in the form describing the subject of the contract for the given Part the name of the manufacturer and the name of the model of the equipment offered. The form describing the subject of the contract for the given Part, including the names of the manufacturer and the model indicated by the Contractor, constitutes the content of the offer. Note! The Contracting Authority allows, at the stage of executing the guaranteed contract and the option contract, the possibility of delivering by the Contractor, at their written request, a different model of equipment than the model indicated in the offer submitted by the Contractor in contract no. 7/pn/2026 for the given Part (this also does not exclude the delivery of a model from a different manufacturer), provided that the conditions set out in the draft contractual clauses are met. Note! Since the subject of the contract in each Part falls within the ICT* category, the Contractor's offer will be subject to verification in accordance with the grounds for rejection of offers provided for in the pzp. *Definitions of the ICT category in accordance with Regulation (EU) 2019/881 of the European Parliament and of the Council of 17 April 2019. Note! The Contracting Authority reserves that the contract for the given Part must be concluded by 31.12.2026. The conclusion of the contract after this date is generally not possible due to the funding of the tasks covered by the contract from the NFZ's 2026 investment expenditure plan. According to the regulations in force in the NFZ, the condition for funding tasks from the 2026 plan is the conclusion of the contract (placement of the order) by 31.12.2026. 2. The Contractor must offer a 36-month warranty and a 36-month defect liability period for the subject of the contract (both the guaranteed contract and the option contract), on the terms set out in the draft contractual clauses. The warranty and defect liability period runs from the date of signing the quality acceptance protocol, respectively, for the subject of the guaranteed contract or the subject of the option contract. 3. Matters relating to equivalence have been described in the contract documents. 4. Matters relating to the contract execution deadline are regulated in the contract documents.
