Description

1. The subject of the order is the delivery of single-use medical equipment for the needs of „Pro-Medica" in Ełk Sp. z o. o.”, number 2673/2026 2. The subject of this public procurement procedure is also the lease of equipment for the duration of the contract: 1) Lot 38 item 4 – Volumetric pump – 2 units; 2) Lot 105 item 2 – Surgical-medical shaver – 4 units; 3) Lot 116 item 5 – Closed system for performing mammotomic biopsy – 1 unit; 4) Lot 143 item 2 – Dispenser for taking gloves to hang on the wall - 60 units; 5) Lot 143 item 3 - Dispenser for taking gloves to hang on the rail - 16 units; 6) Lot 147 item 2 – Metal dispenser for gloves to be mounted on the wall – 10 units 3. The Detailed Description of the Subject of the Order (DDSO) contains Annex No. 3 to the SWZ, i.e. the Commodity-Price Form. 4. The ordering party allows the submission of partial offers (Lot 1-149). 5. The ordering party does not allow the submission of variant offers or in the form of electronic catalogs. 6. The ordering party does not provide for the awarding of orders, as referred to in Article 214(1)(8) of the pzp. 7. The subject of the order, qualified as a medical device, must meet the legal requirements for admission to trade and use in the territory of the Republic of Poland, in accordance with the applicable regulations, i.e. the Act on Medical Devices of 7 April 2022 (i.e. Journal of Laws of 2024, item 1620 as amended) and meet all requirements in accordance with the applicable law. The contractor, at the request of the ordering party, will present certified copies of permits (certificates) in conformity with the original. 8. The ordering party requires that the offered products meet the requirements specified by the applicable law, have been admitted to trade and possess the required valid documents, certifying admission for use in Poland. 9. The description of the subject of the order should be read together with any changes in the content of the specification, which may result from the answers given to the contractors' queries. However, there is no requirement for the ordering party to modify the SWZ and/or its annexes, as they should be read together with any changes. 10. Whenever in the SWZ, by referring to standards, technical assessments, technical specifications and technical reference systems, as mentioned in Article 101(1)(2) and (3) of the pzp, the ordering party allows equivalent solutions to those described, and such a reference is accompanied by the words "or equivalent". 11. In such a case, the given features of the materials, names of manufacturers, product or device should be understood as definitions of standards, and not as specific solutions (not worse than the user, functional and technical parameters of the materials, devices or products indicated in the annexes to the SWZ). 12. A contractor who refers to equivalent solutions in the offer is obliged to prove in the submitted offer that the supplies offered by him meet the requirements specified by the ordering party in the Specification of Order Conditions with the indication of the name and position of the description of the subject of the order, to which it relates, in particular by means of substantive evidence, as referred to in Articles 104-107 of the pzp, that the proposed solutions meet the requirements specified in the description of the subject of the order to an equivalent extent. In such a situation, the contractor will be obliged to attach to the offer their characteristics and evidence confirming the equivalence of the solutions. 13. In the event that an equivalent solution is not indicated in the offer, the ordering party will consider that the contractor will implement the subject of the order in accordance with the solutions indicated in the SWZ. 14. The scope of the contractor's obligations and the manner of implementing the order have been precisely defined in Annex No. 5 to the SWZ – Draft Contract Terms.
