The subject of the contract is the supply of medical equipment, together with the necessary ancillary services for their commissioning (installation, configuration, testing, staff training, etc.). The main purpose of the procurement is to equip SPITALULUI MUNICIPAL TG. SECUIESC with medical equipment, in order to increase diagnostic and treatment capacity. The implementation of the contract is carried out under a suspensive clause, in the sense that the award of the public procurement contract is conditional on the allocation of budgetary credits for this purpose from the funds of the Ministerului Sănătății, the strategic objectives mentioned being to be achieved after ensuring financing. Source of funding: Bugetul Ministerului Sănătății in accordance with the suspensive clause. The contract for the supply, installation, and commissioning of the medical equipment necessary for the equipment of SPITALULUI MUNICIPAL TG. SECUIESC will be carried out under the following suspensive clause: The procedure for awarding the public procurement contract is initiated under the present suspensive clause, in the sense that the award of the public procurement contract is conditional on the allocation of budgetary credits for this purpose from the funds of the Ministerului Sănătății, the contract being signed with respect for the provisions relating to the commitment of expenditure from the budgets that fall under the public finance legislation. Taking into account the provisions of Law 98/2016 on public procurement and H.G. no. 395/2016, with subsequent amendments and additions, the Contracting Authority specifies that it will award the contract to the successful tenderer only to the extent that the funds necessary for the procurement will be ensured by the allocation of budgetary credits for this purpose. In the event that, for whatever reason, the budgetary credits are not allocated, for a period of 24 months from the date of approval of the report of the procedure, the Contracting Authority, after receiving notification of the non-granting of financing, reserves the right not to award the contract and to cancel the procedure, in the event that there is no other source of financing, in accordance with the provisions of Article 212(1)lit.c) paragraph 2 of Law 98/2016 with subsequent amendments and additions, making it impossible to award the public procurement contract. Tenderers in this procedure understand that the Contracting Authority cannot be considered responsible for any damage in the event of cancellation of the award procedure, regardless of the nature of the damage and regardless of whether the Contracting Authority has been notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility in relation to any damage they may suffer in the described situation. The maximum period for which the suspensive clause operates is 24 months, so that, in the event that the condition regarding the granting of financing is not met, the award procedure is cancelled. In this sense, tenderers will submit a declaration on their own responsibility that they agree with these provisions, in their entirety.
