Poland – Furniture – Dostawa wyposażenia niemedycznego i medycznego oraz mebli dla Kliniki Neonatologii i Intensywnej Terapii Noworodka

The subject of the contract is the supply of non-medical and medical equipment as well as furniture for the Neonatology and Intensive Care of the Newborn Clinic. A detailed description and the method of implementing the contract is contained in the assortment-price table No. 2 to the SWZ and the subject of the contract description ("OPZ") No. 3 to the SWZ and the contract template No. 5 to the SWZ. II. The contracting authority does not allow the submission of partial offers. Dividing the contract into parts is not justified for organisational, technical and functional reasons. The subject of the contract includes the supply of comprehensive equipment intended for one, strictly defined organisational unit – the Neonatology and Intensive Care of the Newborn Clinic. The scope of the contract includes both medical, non-medical equipment, and furniture, which functionally serve to ensure the proper equipment and organisation of the Clinic's usable space. These elements remain interconnected in terms of the purpose of implementing the contract, i.e. preparing a complete and ready-to-use infrastructure for the specialist department. The contracting authority has assessed the impact of the potential division of the contract into parts on the implementation of the contract and the achievement of its purpose. As a result of the analysis, it was found that dividing the contract into parts could threaten the timely implementation of the contract and the launch of the Clinic's activities by increasing the organisational and technical risk, especially in terms of coordinating deliveries, installation, and placement of individual equipment elements, as well as responsibility for the proper implementation of the contract in the case of cooperation with different contractors. Furthermore, it should be noted that the subject of the contract has been described in a way that ensures the principles of fair competition and equal treatment of contractors. The contracting authority has not specified requirements that would unjustifiably limit the circle of potential contractors (the subject of the contract is generally available on the market), and the applied model of implementing the contract remains proportional to its purpose and character. Taking into account the above circumstances, the contracting authority considered that the implementation of the contract within one procedure and one contract will ensure the most effective, economical and purposeful execution of the contract, limit the risks associated with the coordination of the implementation, and allow for the acquisition of complete equipment for the Neonatology and Intensive Care of the Newborn Clinic in a timely and compliant with the requirements of the contracting authority. III. In accordance with Article 13(1) and (2) and Article 14(1) and (2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU. L. 2016 No 119, p. 1) ("GDPR") we would like to inform you about the principles of processing personal data in the event that the contracting authority processes your personal data in connection with the conduct of the public procurement procedure. 2. The controller of your personal data is the contracting authority. 3. The contracting authority can be contacted regarding matters related to the protection of personal data: 1) by sending a letter to its registered office or electronically via email correspondence to the address: [email protected] or 2) via the ePUAP platform to the address: /IMiDWarszawa/SkrytkaESP. 4. The contracting authority has appointed a Data Protection Officer ("DPO"), with whom you can contact regarding the processing of your personal data. Contact with the DPO is possible via email to the address: iod@imid. or by telephone (22) 32 77 495 or by mail to the registered office of the contracting authority. 5. The contracting authority processes your personal data for the following purposes: 1) conducting a public procurement procedure – on the basis of Article 6(1)(c) GDPR in conjunction with Article 9(2)(g) GDPR in conjunction with the provisions of the Public Procurement Law; 2) verification of information on non-criminality within the framework of evidentiary means – on the basis of Article 6(1)(c) in conjunction with Article 10 GDPR in conjunction with the provisions of the Public Procurement Law; 3) archiving personal data – on the basis of Article 6(1)(c) GDPR in conjunction with Article 9(2)(j) GDPR in conjunction with the Act on the National Archival Resource and Archives; 4) establishing, pursuing or defending claims in connection with the conducted activity – on the basis of Article 6(1)(e) GDPR or Article 9(2)(f) GDPR, i.e. processing is necessary for the performance of a task carried out in the public interest – proper management of the contracting authority's property, i.e. conducting an important public procurement procedure, guaranteeing the proper expenditure of public funds. The detailed GDPR information clause has been included in the SWZ. IV. The subject of the contract is carried out within the framework of the granted targeted grant for co-financing from the state budget for the implementation of the investment programme entitled "Creation of an interdisciplinary treatment and diagnostics centre of the Institute of Mother and Child" - contract No. DOI/FM/SIS/2/106/1155/2023.
