Description

1. The subject of the contract is the supply of medicinal products used in drug and cancer chemotherapy programs for the needs of the USK-2 Clinics of the Pomeranian Medical University in Szczecin. The description of the subject of the contract and the estimated quantities relating to the products have been included in the unit price form (Annex 2 to SWZ, hereinafter also as FCJ). 2. The contracting authority requires the offer of medicinal products in accordance with the Act of 6 September 2001 on Pharmaceutical Law (Journal of Laws 2001.126.1381 as amended), introduced into circulation and use in the territory of the Republic of Poland in accordance with the applicable provisions. 3. The contracting authority requires that the offered medicinal products are listed in Annex B to the Announcement of the Minister of Health on the list of reimbursed medicines (medicines available in drug programs). NOTE! This does not apply to task no. 6. Failure to meet the condition described in point 2 and 3 will result in the rejection of the offer. 4. The contracting authority requires that the period of validity for use of all offered products is a minimum of 12 months, calculated from the date of delivery to the contracting authority's address. 5. The quantities of the assortment constituting the subject of the contract specified in the annex to the contract are estimated values, serving to correctly calculate the price of the offer, compare offers and choose the most advantageous offer. The quantity of the ordered assortment, within the framework of the contract implementation, may be reduced or increased, within the framework of individual assortment positions depending on the actual needs of the contracting authority, with the reservation that the value of the offer and thus the contract of the selected contractor will not be exceeded. The contracting authority has the right not to realise the full quantity and assortment of the contract specified in the contract. In such a situation, no claims will be made to the contractor. The contracting authority has the right not to realise the full subject of the contract. The qualification of patients for drug programs is carried out on the basis of criteria established by the Ministry of Health and NFZ. The contracting authority has no real influence on this, and therefore cannot declare a minimum level of contract implementation. 6. The contracting authority, pursuant to art. 30 para. 2 of the PZP Act, awards the contract in parts, each of which is the subject of a separate procedure. 7. The contract consists of 8 tasks, a detailed description of which is contained in Annex no. 2 FCJ. The contracting authority does not allow the submission of partial offers. 8. The contracting authority does not allow the submission of alternative offers. 9. The contracting authority requires the implementation of the subject of the contract for a period of 24 months, calculated from the date of conclusion of the contract.
