Description
1. The subject of the order is - under the conditions described in the contract, which will be concluded between the Purchaser and the Contractor, SWZ and in the Contractor's offer - the successive transfer by the Purchaser to the Contractor of waste classified under code 20 01 10 - clothing and 20 01 11 textiles. 2. Waste may be subjected only to recovery processes from R1 to R12, in accordance with the definition of these processes in the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2023, item 1587, as amended) / Regulation (EU) 2024/1157 of the European Parliament and of the Council of 11 April 2024 on the movement of waste, amending Regulations (EU) No 1257/2013 and (EU) 2020/1056 and repealing Regulation (EC) No 1013/2006 (Official Journal of the European Union L 2024.1157), where "subjection to a recovery process" means the initiation and completion of this process. 3. The subject of the Order includes the successive transfer of waste classified under code 20 01 10 – Clothing and 20 01 11 – Textiles in an amount of 1000 Mg selectively collected – but not less than 400 Mg of waste classified under code 20 01 10 and waste classified under code 20 01 11 (minimum service). 4. Waste collection: 1) The transfer and collection of Waste will take place exclusively on the basis of and in accordance with written [form under penalty of invalidity] individual orders of the Purchaser addressed to the Contractor and delivered by electronic mail, specifying the quantity of Waste and the date by which the Purchaser expects their collection. 2) The Purchaser will place individual orders when the quantity of Waste accumulated by him, which is to be collected in one day, will be at least 16 Mg, 3) The Contractor will collect Waste while maintaining the following technical infrastructure requirements at the Purchaser's facility: a) the gross weight of a single vehicle entering (empty vehicle for loading) the Purchaser's facility may not exceed 18 tonnes b) the distances between the outermost axles of a single vehicle may not exceed 16 metres, and the length of the vehicle may not exceed 18 m c) loading of waste transferred in bulk is done "from above" 4) After weighing the vehicle loaded with Waste, the Purchaser will issue a document of issue from the warehouse. 5) The Purchaser will prepare a Waste Transfer Note [KPO] with a breakdown by codes 20 01 10 - clothing and 20 01 11 - textiles for each batch of Waste collected from the facility operated by him by the Contractor's transport. These notes will be issued in accordance with the Waste Act. The Contractor will be responsible for confirming by the Operator of the Installation, in which the recovery process will be carried out, the mass and type of Waste specified in each Waste Transfer Note issued by the Purchaser, in accordance with the Waste Act. 6) If the movement of Waste is of an international nature, the documents specified in Regulation (EU) 2024/1157 of the European Parliament and of the Council of 11 April 2024 on the movement of waste, amending Regulations (EU) No 1257/2013 and (EU) 2020/1056 and repealing Regulation (EC) No 1013/2006 will be prepared. The documents will be prepared in accordance with the requirements of the above Regulation. 4. Pursuant to Article 16b(2) of the Public Procurement Act, the Purchaser informs that it does not allow tenders with supplies or services originating from third countries not party to international agreements. A tender covering supplies or services originating from third countries not party to international agreements will be rejected pursuant to Article 226(1)(5) of the Public Procurement Act: “The Purchaser rejects the tender if its content is not in accordance with the terms of the order”.
