1. The subject of the contract is the supply and installation of a redundant disk array, including implementation works. 2. The detailed description of the subject of the contract contains the Contract Template with Annexes, which is Annex No. 10 to the SWZ. 3. The contracting authority does not require the contract to be carried out by sheltered workshops, social cooperatives, or other contractors covered by the provisions of Article 94(1) of the Act. 4. Due to the nature of this contract (supply), the contracting authority does not require the employment of persons (by the Contractor or subcontractors) based on an employment relationship. 5. The contracting authority does not foresee the possibility of awarding contracts, as referred to in Article 214(1)(8) of the Act. 6. The contracting authority does not allow the submission of variant offers. 7. The contracting authority does not foresee the conduct of an electronic auction. 8. Before initiating the procedure, the contracting authority did not conduct preliminary market consultations. 9. In this procedure, the contracting authority does not divide the contract into parts or allow the submission of partial offers, with the following justification: The contracting authority has decided not to divide the contract into parts, as the subject of the contract includes the supply and implementation of a redundant disk array along with a comprehensive overhaul of the mass storage environment of the City Office of Krakow. The individual elements of the contract, including the supply of the device, reconfiguration of the SAN network, configuration of replication mechanisms, data migration, restoration of high-availability mechanisms, and the performance of acceptance tests, constitute a technologically and functionally interconnected process, the correct implementation of which requires maintaining full compatibility and the responsibility of a single contractor for the entire implementation. Dividing the contract into parts could lead to problems related to the coordination of work carried out by different contractors, the dilution of responsibility for the proper functioning of the environment, the prolongation of the implementation process, and the increased risk of downtime or loss of continuity of the contracting authority's information systems. Therefore, the lack of division of the contract into parts is justified by technical, organizational reasons, and the need to ensure the safe and coherent implementation of the entire process of migrating the mass storage environment. The lack of division into parts does not limit access to the contract for small and medium-sized enterprises, and contractors operating in the industry covered by the subject of the contract can supply all its elements. 10. Within the limits set by Article 462 and subsequent articles of the Act, the contracting authority allows the possibility of implementing the subject of the contract by the Contractor using subcontractors. A contractor who intends to entrust the execution of part of the contract to subcontractors indicates in the offer the parts of the contract, the execution of which they intend to entrust to subcontractors, and provides the names of potential subcontractors, if known. 11. In this procedure, the contracting authority does not require contractors to submit tangible evidence.
