France – Installation of road signals – Travaux de signalisation verticale sur les routes territoriales de Corse

The framework agreement will be executed by the issuance of purchase orders. Each lot will be the subject of a separate award. The services are settled by unit and lump-sum prices. The works consist of the replacement, extension, maintenance, reinforcement or removal of vertical signalling equipment. This framework agreement derogates from the principle of exclusivity. The contracting authority reserves the right, throughout the duration of the contract, to use third parties for certain types of work provided for in this framework agreement. Independently of this framework agreement, restricted procedures, as well as negotiated procedures without prior publication of a contract notice, may be initiated when the contracting authority is able to use them. This clause may be used for services of less than 10 000 euro(s) excluding VAT, within the limit of a total annual cumulative amount not exceeding 10% of the maximum annual amount provided for by this framework agreement. This principle of non-exclusivity may apply when the lot holder is unable to provide the service ordered (failure), or in the context of a global operation. By impossibility to execute the services, any difficulty encountered by the holder that prevents them from meeting the needs expressed by the contracting authority. In such a case, the holder informs the contracting authority in writing. The holder may not make any claim in this regard.
