Description
The subject of the contract is the delivery of 861 mobile computers for the needs of the City Office in Stalowa Wola and its subordinate units. 2. The project is supported by BGK from the funds of the National Reconstruction and Resilience Plan from the investment C4.1.1. – Support for advanced digital transformation. 3. The equipment and accessories offered as part of the subject of the contract must: a. meet the requirements specified in the description of the subject of the contract, b. be in accordance with the specified parameters/functionalities, c. be factory new and complete (with full cabling), d. be assembled, tested and ready for use, e. be originally packaged, with the contents of the packages described, f. be marked by the manufacturer in such a way as to allow identification of both the product and the manufacturer, g. be of high quality and free from defects and third-party rights, h. come from legal sources, i. be approved for use in a public institution, j. meet the quality standards specified in the relevant legal acts, if they relate to the subject of the contract. 4. The Detailed Description of the Subject of the Contract, including the parameters of the equipment required by the Contracting Authority, is described in Annex No. 1 to SWZ – Description of the Subject of the Contract – Itemised Price Form. 5. The Contractor, together with, inter alia, the offer form, as part of their offer, should submit Annex No. 1 - OPZ - Itemised Price Form – completed and signed by the Contractor, in order to confirm, inter alia, the parameters of the offered equipment; 6. Place of delivery of the equipment: ul. Kwiatkowskiego 1 (City Office Building - II Floor), 37-450 Stalowa Wola. 7. The Contracting Authority does not require the Contractor to conduct a local inspection or to check the documents necessary for the implementation of the contract on the premises of the Contracting Authority. 8. The Contractor may limit themselves to completing section α in part IV of the Single European Procurement Document (SEPD) and does not have to complete any of the other sections in part IV of the SEPD. 9. The Contractor, pursuant to Article 95(1) of the Pzp Act, shall be obliged to: 1) Employ by the Contractor or Subcontractor, on the basis of an employment contract, persons performing activities in the scope of the implementation of the contract, the performance of which consists of performing work in the manner specified in Article 22 of the Act of June 26, 1974 - Labour Code (consolidated text Dz. U. of 2022 item 1510, 1700, 2140, of 2023 item 240) the following activities: - The Contracting Authority does not specify detailed requirements in this regard 11. The Contracting Authority requires that the subject of the contract offered, including all ICT products or ICT services or ICT processes used to implement the contract, does not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of July 5, 2018 on the national cybersecurity system (Dz. U. of 2026 item 20 with later amendments), stating their negative impact on the fundamental interest of the state's security; 2) an ICT product, the type of which has been determined in a decision on the recognition of a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of July 5, 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. - Failure to meet the above requirement results in the rejection of the offer on the basis of Article 226(1) point 17 or point 19 of the Pzp Act. 12. The Contractor submits the Itemised Form drawn up according to the template constituting the Annex to SWZ - Annex No. 8. This list is an integral part of the offer and serves to identify ICT products, ICT services and ICT processes covered by the offer or used to implement the contract. 13. The Contracting Authority will verify the information provided by the Contractor on the basis of publicly available information, in particular recommendations published in the Public Information Bulletin on the website of the Government Plenipotentiary for Cybersecurity and decisions announced in the Official Journal of the Republic of Poland "Monitor Polski", as well as those published in the Public Information Bulletin on the website of the minister competent for informatisation and on the website of the office serving that minister. 14. If the Contractor provides information that an ICT product, ICT service or ICT process covered by its offer has been indicated in a recommendation or decision, as referred to in point 13 sub-point 1 or 2, it is obliged to immediately inform the Contracting Authority thereof. 15. The Contractor is obliged to implement the contract using ICT products, ICT services and ICT processes in accordance with the content of the offer, the contract documents and the provisions of the contract. Replacement during the implementation of the contract of the manufacturer, technology supplier, model, version, service provision environment or ICT process may only take place in legally permissible cases and with the requirements resulting from Article 454 and Article 455 of the Pzp Act, as well as in accordance with the provisions of the contract specifying the permissible bases and conditions for change. Such a change must not be in conflict with the contract documents or result in the implementation of the contract with an ICT product, ICT service or ICT process, in respect of which there would be circumstances corresponding to the circumstances specified in Article 226(1) point 17 or point 19 of the Pzp Act. 16. In the event of the publication of a recommendation or decision covering an ICT element used to implement the contract, the Contractor shall immediately inform the Contracting Authority and present the method of ensuring the further compliance of the implementation of the contract with the provisions of the law and the contract documents.
