Description

I. 1. The subject of the contract is „Delivery of road salt for the winter season 2026/2027” 2. The contract includes: delivery of non-brined road salt (in powdery, crystalline form) along with loading, transport and unloading in a maximum quantity of 1 600 Mg within the framework of the basic contract to the Road and Bridge District in Bełżyce and a maximum quantity of 500 Mg within the framework of the option right to the Road District in Bychawa for the needs of carrying out winter road maintenance actions, i.e. combating slipperiness on county roads. The salt should be delivered within the framework of the basic contract to the Road and Bridge District No. 1 in Bełżyce, ul. Żeromskiego 3, 24-200 Bełżyce, within the framework of the option right to the Road District No. 2 in Bychawa, ul. Reymonta 4D 23-100 Bychawa (to the indicated place of its storage). A detailed description of the subject of the contract is in Annex No. 1 to SWZ. II. The Contracting Authority, pursuant to Article 139(1) of the Pzp Act, will first carry out an examination and evaluation of the offers, and then qualify the contractor, whose offer was most highly evaluated, in terms of the lack of grounds for exclusion and the fulfillment of the conditions for participation in the procedure. III. The Contracting Authority envisages the invalidation of the procedure in the sense of Article 257 of the Pzp. IV. Exclusion grounds of an exclusively national character: 1) exclusion of the contractor in the event of conviction for an offence referred to in Article 47 of the Act on Sport; 2) exclusion of the contractor in the event of conviction for offences against the credibility of documents and offences against economic turnover (Article 108(1)(1)(g) and (2) of the Pzp Act), i.e. for offences referred to in Articles 270-277d of the Criminal Code [offences against the credibility of documents] and offences referred to in Articles 296-307 of the Criminal Code [offences against economic turnover], with the exception of the offence of impeding or obstructing the establishment of the criminal origin of money or concealing its origin, referred to in Article 299 of the Criminal Code. 3) exclusion of the contractor, against whom a ban on applying for public contracts has been definitively imposed (Article 108(1)(4) of the Pzp Act); the ban is imposed on a collective entity on the basis of the provisions of the Act of 28 October 2002 on the liability of collective entities for prohibited acts punishable by imprisonment (Journal of Laws of 2016, item 1541 and 2017, items 724 and 933), and on a natural person on the basis of the provisions of the Code of Criminal Procedure. 4) Article 108(2) of the Pzp Act, 5), Furthermore: 1a. pursuant to Article 7(1) of the Act of 13 April 2022 „On special solutions in the field of counteracting the support of aggression against Ukraine and serving to protect national security” (Journal of Laws 2025, item 514) from the procedure for the award of the contract, the following are excluded: 1) the contractor and the participant in the tender listed in the lists specified in Regulation 765/2006 and Regulation 269/2014 or entered on the list on the basis of a decision on entry on the list determining the application of the measure referred to in Article 1(3); 2) the contractor and the participant in the tender, whose ultimate beneficiary, within the meaning of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2023, items 1124, 1285, 1723 and 1843), is a person listed in the lists specified in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such an ultimate beneficiary from 24 February 2022, if it was entered on the list on the basis of a decision on entry on the list determining the application of the measure referred to in Article 1(3); 3) the contractor and the participant in the tender, whose dominant entity, within the meaning of Article 3(1)(37) of the Act of 29 September 1994 on Accounting (Journal of Laws of 2023, items 120, 295 and 1598), is a subject listed in the lists specified in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a dominant entity from 24 February 2022, if it was entered on the list on the basis of a decision on entry on the list determining the application of the measure referred to in Article 1(3) of the aforementioned Act. 1b. Pursuant to Regulation 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, in its current wording, the Contractor who belongs to any of the categories of entities listed in Article 5k(1) of the Regulation shall be excluded. V. Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119 of 04.05.2016, p. 1), hereinafter „RODO”, the Contracting Authority informs that: 1) It is the administrator of the personal data of the Contractor and of the persons whose data the Contractor has provided in this procedure; 2) The personal data of the Contractor will be processed on the basis of Article 6(1)(c) of the RODO for the purpose related to the procedure for the award of the public contract for the task entitled: „Delivery of road salt for the winter season 2026/2027” conducted in the open tender procedure; 3) The recipients of the personal data of the Contractor will be persons or entities to whom the documentation of the procedure will
