The subject of the Contract is Meteorological Monitoring at the Lubiatowo – Kopalino Location with servicing and maintenance of the entire measurement system along with the accompanying infrastructure. 2. The Purchaser envisages the possibility of applying the right of option, in accordance with art. 441 of the PZP Act. The subject of the contract, divided into the basic and optional scope, includes the following tasks: 2.1. Basic Scope: a) Conducting Meteorological Monitoring with full quality control of data for the Lubiatowo-Kopalino Location, in accordance with the Methodology for Conducting Meteorological Monitoring; b) Servicing and maintenance of the Measurement System and Accompanying Infrastructure of Lubiatowo (Location of the Measurement System and Accompanying Infrastructure of Lubiatowo-Kopalino); c) Expert Support. 2.2. Optional Scope: Temporary extension of Monitoring by including an additional measurement point in the Measurement System at a new Location indicated by the Purchaser, with simultaneous conduct of Monitoring at the previous Locations. The circumstances and conditions related to the use of the optional scope are specified in the contractual provisions of the project. 3. The Purchaser reserves the right that within the framework of the Expert Support referred to in point 2.1. lit. c), the Contractor will remain on standby to provide the Purchaser with services in the maximum amount of 300 man-hours, with the reservation that the Purchaser is obliged to use 50 man-hours. The use of the remaining 250 man-hours will be the sole decision of the Purchaser, and the Contractor has no right to demand their assignment or claim on this basis. 4. A detailed description of the subject of the Contract is contained in Annex A to the Draft Contractual Provisions, which constitute Annex No. 1 to the SWZ. 5. The provisions of the Act of 29 June 2011 on the preparation and implementation of investments in the field of nuclear energy facilities and related investments (Chapter 6) (i.e. Journal of Laws of 2025, item 1156, as amended) (hereinafter referred to as the Investment Act) also apply to the subject of the Procedure. 6. Whenever this Notice refers to the Specification or SWZ, it means the Specification of Contract Conditions together with the annexes, which are an integral part thereof. 7. The Purchaser informs that the public procurement procedure will be conducted using the Purchaser's Procurement Platform. 8. The address of the website of the conducted Procedure: https://pz.pej.pl (under this address, changes and explanations of the content of the SWZ as well as other documents of the Contract directly related to the Procedure for awarding the Contract will be made available). 9. In this procedure, communication between the Purchaser and the Contractors, including the submission of Offers, exchange of information and transmission of documents or declarations, with the exception of exceptions indicated in the PZP Act, is carried out using electronic communication means via the Platform, available at: https://pz.pej.pl. 10. A Contractor intending to participate in the procedure for awarding the contract must have an account on the Procurement Platform. Registration and maintenance of an account on the Procurement Platform as well as the use of the Platform is free of charge. 11. The technical and organisational requirements for using the Platform are specified in the Platform Regulations (available at the internet address https://pz.pej.pl/user/terms). A Contractor participating in the procedure for awarding the contract, i.e. registering or logging in (in the case of having an account on the Platform) free of charge, accepts the terms of using the Platform, specified in the Regulations and acknowledges them as binding. 12. Detailed information on electronic communication means is contained in point 17 of the SWZ. 13. The Purchaser, pursuant to art. 139 para. 1 of the PZP Act, envisages the so-called reverse procedure, i.e. first conducts an examination and evaluation of Offers to determine the highest-rated Offers, and then conducts a subject qualification of Contractors whose Offers have been highest-rated in terms of lack of grounds for exclusion and meeting the conditions for participation in the Procedure. Information in this regard is contained in point 15 of the SWZ. 14. The Contractor, to confirm the lack of grounds for exclusion, is obliged to submit with the Offer: 15.1) Pursuant to art. 393 para. 1 point 3 of the PZP Act, in order to demonstrate the lack of grounds for exclusion referred to in point 13.3. of the SWZ, the Contractor submits a declaration, the Template of which is Annex No. 10 to the SWZ. 15.2) In the case of relying on the capacities or situation of other entities providing resources, the Contractor, together with his declaration referred to in point 15.1) above, also submits a declaration of the entity providing resources, confirming the lack of grounds for exclusion. 15.3) In the case of joint bidding for the Contract by Contractors, the declaration referred to in point 15.1) above is submitted by each of the Contractors jointly bidding for the Contract. 15.4) In the case where the Contractor plans to entrust part of the contract, constituting more than 10% of the contract value, to be performed by subcontractors and suppliers, and they are known, the Purchaser requires the Contractor to submit a declaration, referred to in point 15.1) above, in respect of those subcontractors and suppliers. 16. The Purchaser, pursuant to art. 139 para. 2 of the PZP Act, in connection with point 2.3 of the SWZ, will require the submission of a JEDZ declaration, exclusively from the Contractor whose Offer is highest-rated. Information in this regard is contained in point 15 of the SWZ. 17. The Purchaser, before selecting the most advantageous offers, will call upon the Contractors whose offers have been highest-rated to submit, within a specified timeframe, not shorter than 10 days, declarations and subject evidence means current on the date of submission, referred to in point 15 of the SWZ.
