1. The subject of the contract is: Supply of concrete mining covers for the lining of walkways for the Divisions of Polska Grupa Górnicza S.A. - group number 288-5. 2. CPV code: 44113330. 3. The detailed description of the subject of the contract as well as the legal requirements and technical-user parameters are specified in Appendix No. 1 to this SWZ. The quantitative scope of the subject of the contract is the estimated scope determined by the Contracting Authority with due diligence. The Contracting Authority, despite exercising due diligence, does not guarantee the full implementation of the contract due to the nature of the activity carried out. 4. In order to confirm that the offered service is in accordance with the requirements of the Contracting Authority, it is necessary to submit with the offer the relevant evidentiary means. 5. The Contracting Authority does not allow the submission of alternative offers. 6. The Contracting Authority allows the possibility of offering more than one product (products of different manufacturers) within the scope of one position of the offer form. If the contractor offers more than one product (products of different manufacturers) in a given position of the offer form, the following is required: a) each offered product must meet the requirements specified in the SWZ, b) submission of relevant evidentiary means regarding all offered products. An offer in which products of different manufacturers are offered within the scope of one position of the offer form is considered to be in accordance with the requirements of the SWZ, provided that all offered products in the given position of the offer form meet the requirements. In the event that even one of the offered products does not meet the requirements, the offer is subject to rejection pursuant to Article 226(1)(5) of the Pzp Act. 7. The Contracting Authority reserves the right to change the quantity of ordered goods within the scope of individual assortment positions and to place orders according to actual needs, with the reservation that the total value of deliveries will not exceed the value of the contract. 8. The Contracting Authority declares that the minimum guaranteed level of contract performance is 50% of the value of the order placed. Contractors are not entitled to claims for contract performance to a greater extent. 9. The procedure for awarding the sectoral contract is conducted in the form of an unlimited tender in accordance with the provisions of the Act of 11 September 2019 on Public Procurement (Dz.U. poz. 2019 ze zm.), hereinafter referred to as the Pzp Act. 10. The procedure is conducted in the Polish language. 11. The information obligation arising from Article 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L.2016.119.1 of 4 May 2016) (hereinafter referred to as the "GDPR") has been fulfilled on the PGG S.A. website in the GDPR tab, in the annex "Contractors/Employees of Contractors". In the event of processing personal data for a purpose related to the public procurement procedure, the Contracting Authority has fulfilled the information obligation in the Buyer's Profile on the Polska Grupa Górnicza website in the "Public Procurement Information Obligation" tab. 12. Additionally, the Contracting Authority informs that a) the exercise by a data subject of the right to rectification or completion, referred to in Article 16 of the GDPR, cannot result in a change in the outcome of the procedure for awarding the contract or a change in the provisions of the contract relating to the public procurement procedure in a manner inconsistent with the law. b) in the procedure for awarding the contract, the submission of a request for restriction of processing, referred to in Article 18(1) of the GDPR, does not restrict the processing of personal data until the completion of that procedure. 13. The Contracting Authority allows the possibility of submitting partial offers for individual parts of the contract (tasks) specified in Appendix No. 2 to the SWZ. The submitted offer must cover the entire scope of the subject matter and quantity of the part of the contract. The number of parts of the contract (tasks) is: 3. 14.
