Description

The subject of the contract is the purchase and delivery of computer equipment for the Silesian garrison as part of a framework agreement with a division of tasks as follows: 1) Task 1 - AIO type computer - quantity: 3000 2) Task 2 - Laptop type portable computer - quantity: 500 3) Task 3 - Mini PC computer with monitor - quantity: 3000 2. The Buyer will conclude a framework agreement for each task separately with a maximum of four (4) Contractors whose offers meet all the requirements of the SWZ and the Pzp Act and will receive the highest number of points based on the offer evaluation criteria specified in Section XX of the SWZ. In the event that fewer offers not subject to rejection are submitted, the Buyer will conclude a framework agreement with all Contractors for the given task who meet all the requirements of the SWZ and the Pzp Act. If one offer not subject to rejection is submitted for a given task, the Buyer will conclude a framework agreement with one Contractor. 4. The Buyer has indicated the minimum technical parameters for the devices and equipment in Annex No. 7 to the SWZ. The Contractor may offer devices and equipment with higher parameters. Offering devices and equipment that do not meet the Buyer's minimum requirements will result in the rejection of the offer under Article 226(1)(5) of the Pzp, as not meeting the tender conditions. 5. The details of the contract are contained in the SWZ and the annexes. 6. The value of the framework agreement will not exceed the amount of 34,440,000.00 PLN gross (the amount which the Buyer intends to allocate for the implementation of the contract), including: for Task 1: 16,848,540.00 PLN for Task 2: 1,706,010.00 PLN for Task 3: 16,848,540.00 PLN Settlement for completed deliveries will be made on the basis of separate execution contracts concluded on the basis of the unit prices indicated in the tender form - Annex No. 1 to the SWZ, subject to § 6 of the draft contractual provisions. 7. Contractors may jointly apply for the award of the contract. 8. In the case of consortia and civil law partnerships, a separate declaration of non-exclusion, compliance with the conditions of participation in the procedure or selection criteria must be provided for each of the co-contractors. Such a declaration confirms compliance with the conditions of participation in the procedure or selection criteria and the absence of grounds for exclusion only in relation to a given consortium member or partner (Article 125(4) of the Pzp). This means that each of the co-contractors demonstrates in the declaration only their own capabilities (resources). 9. In the case referred to in paragraph 1, the Contractors appoint a representative to represent them in the procedure for the award of the contract or to represent them in the procedure and conclude a contract in the matter of a public contract. 10. The offer must be signed in such a way as to legally bind all Contractors acting jointly. 11. In the case of joint application by Contractors for the award of the contract, the documents and declarations specified in Section VIII, points 1.2 and 2.1, are also submitted by the Contractor jointly applying for the award of the contract. The provisions of Section VIII, paragraph 2.2-2.5, shall apply mutatis mutandis. 12. The Contractor may entrust the execution of part of the contract to a subcontractor. 13. The Buyer requires the Contractor to indicate in the offer the part of the contract which the Contractor intends to entrust to subcontractors, and to provide the names of any potential subcontractors, if known. This is indicated in Annex No. 1 to the SWZ. If the Contractor does not intend to execute the contract with the involvement of subcontractors, "not applicable" or a similar formulation should be entered in Annex No. 1 to the SWZ. If the Contractor leaves this field on the form blank (empty field), the Buyer will assume that the contract will be executed with its own resources, without the involvement of subcontractors. 14. Entrusting the execution of part of the contract to subcontractors does not release the Contractor from responsibility for the proper execution of the contract.
