The procedure will be divided into four parts: The subject of the procurement is: - in the 1st part, maintenance and repair works on green areas located in the central urban area of Gyöngyös, - in the 2nd part, maintenance and repair works on green areas located in Mátrafüred, - in the 3rd part, tree works in the central urban area of Gyöngyös, - in the 4th part, tree works and other works in the central urban area of Mátrafüred according to the items listed in the attached budget estimate. The contracting authority concludes a framework agreement with the tenderer for the performance of municipal park maintenance works, the total net framework amounts during the validity of the framework agreement being: - in the 1st part, a total of net 190,290,126 Ft, - in the 2nd part, a total of net 15,379,715 Ft, - in the 3rd part, a total of net 22,388,944 Ft, - in the 4th part, a total of net 3,484,227 Ft. General provisions for all parts: The detailed definition of the tasks to be performed is contained in the budget estimate attached to the tender documentation. In the second, consultative phase of the procedure, the contracting authority will conduct consultative procedures pursuant to Section 105 (1) c) of the Public Procurement Act. The contracting authority will conduct two planned consultative procedures, the first one within 15 days after the conclusion of the framework agreement, and the second one within 15 days after the approval of the contracting authority's 2027 budget. The specific tasks and their quantities will be precisely defined during the consultative procedures to be conducted as the second part of the framework agreement pursuant to Section 105 (1) c) of the Public Procurement Act. Therefore, the tasks to be performed listed below are for information purposes only, and the quantitative data provided are estimated main quantitative data for one year. The specific tasks to be performed by the winning tenderer and their quantities, as well as the unit prices according to the individual contract, will be fixed in the individual contract after the consultative procedure. Where this invitation or any attached procurement document mentions the ordering of any work, it should be understood as ordering through the conclusion of an individual contract following the conduct of the consultative procedure pursuant to Section 105 (1) c) of the Public Procurement Act. The detailed definition of the tasks to be performed, the detailed requirements and the detailed designation of the areas affected by the work are contained in the procurement documents. The validity of the framework agreement may be extended by 3 months, and taking into account that the quantity of the works to be performed within the framework of the service is influenced by unpredictable weather conditions, the actual quantity may deviate by 30% during the performance of the individual contracts, and accordingly, the framework amount may be increased by up to +30% under the conditions of the framework agreement. These modifications are considered a modification pursuant to Section 141 (4) a) of the Public Procurement Act. The contracting authority notes that it is not obliged to exhaust the framework amount during the consultative procedures, and that the actual consideration of the procured service to be paid does not exceed the framework amount, taking into account the provisions of Section 104 (8) of the Public Procurement Act. The contracting authority will pay the consideration for the individual tasks after the contractually proper performance of the works, based on the proof of completion, using the net unit prices as the basis, the "Net Entrepreneurial Fee" contained in the table detailing the tender price being the calculated data serving as the basis for evaluation. Contracting condition: The contracting authority requires that the winning tenderer must have, by the latest the day of the conclusion of the framework agreement, professional liability insurance covering any damages caused in connection with any activity constituting the subject of the procurement (park maintenance services) valid and effective at the time of tender submission - in the case of a tender for the 1st part: at least 5 Mft/incident, 50 Mft/year coverage limit, - in the case of a tender for the 2nd part: at least 5 Mft/incident, 10 Mft/year coverage limit. - in the case of a tender for the 3rd part: at least 5 Mft/incident, 10 Mft/year coverage limit. - in the case of a tender for the 4th part: at least 1 Mft/incident, 5 Mft/year coverage limit. The winning tenderer is obliged to maintain the aforementioned liability insurance for the entire duration of the framework agreement. The winning tenderer is obliged to prove the existence of the liability insurance cover by sending/handing over a copy of the insurance policy and the cover note to the contracting authority upon the conclusion of the framework agreement, and subsequently during the validity of the framework agreement upon request by the contracting authority. The contracting authority considers the lack or refusal to provide proof of the prescribed liability insurance cover by the latest at the time of contracting as withdrawal from the framework agreement. Withdrawal from contracting is considered an event pursuant to Section 54 (4) of the Public Procurement Act. Further and detailed conditions are contained in the further provisions of the invitation, the technical documents attached as procurement documents, the budget estimates without prices, and the draft contracts. With regard to the character limitation of the EKR, the quantitative data of the individual parts are contained in point II.4.2. (BT-24).
