Construction of an open all-day primary school at Gewerbeschulstr 109 in Wuppertal Installation of a BMA system. In addition to the production of the BMA system, the optional procurement of maintenance services is part of this tender. The prices for the maintenance services must - in addition to the prices for the main services - be entered by the bidders in the list of services and will be included in the tender evaluation. The maintenance services can be optionally called up as needed by the contracting authority, at the latest at the time of acceptance of the completed system. The term of the maintenance contract is 4 years from acceptance. There is no obligation on the part of the contracting authority to use the option. This means that the future contractor has no legal claim to the call-up of the maintenance services, but is obliged to provide the maintenance service if the option is exercised by the contracting authority. With the award of the contract, the option right becomes part of the contract. The exercise of the option right by the contracting authority does not constitute a new contract in legal terms.
