Description
The procedure is conducted in accordance with the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793), hereinafter referred to as the PPA. The procedure is conducted in the form of an unrestricted tender in accordance with Article 132 of the PPA. The Contracting Authority awards the contract in parts, each of which is the subject of a separate procedure. The subject of the contract is the supply of fruit. Common Procurement Vocabulary (CPV) code: 03220000-9 Vegetables, fruit and nuts. The detailed description of the subject of the contract is specified in Annexes No. 1, 1.1., 5 and No. 4 to the SWZ, i.e.: Tender Form, Assortment and Price Specifications, Descriptions of Contract Items and Draft Contract Clauses. The Contracting Authority does not allow partial tenders to be submitted. Reason: The Contracting Authority does not allow partial tenders to be submitted, as the subject of the contract covers successive deliveries of fruit, which require the continuity of supplies, a uniform level of quality and efficient organisation and coordination of the implementation of the contract. Dividing the contract into parts and entrusting their implementation to several contractors could hinder the current coordination of supplies, especially in terms of deadlines, quantities and quality of the delivered products. In the event of shortages, delays or the need to exchange products, additional coordination of actions between the Contracting Authority and individual Contractors would be necessary, which could negatively affect the continuity of supply. Furthermore, supplies made by different Contractors could be associated with differences in quality, freshness and the manner of delivery, which would make it difficult to ensure the uniform standards required by the Contracting Authority. Dividing the contract could also result in increased organisational and logistical costs, related to, among others, servicing several contracts, coordinating multiple supplies and controlling their proper implementation. For the above reasons, the Contracting Authority considers that the implementation of the entire contract by one Contractor will ensure more efficient organisation of supplies, greater continuity and predictability of supply and a uniform quality standard of the delivered fruit, and will also help to limit the costs and risks associated with coordinating cooperation with many Contractors. The Contracting Authority requires an offer to be submitted for all the required positions listed in Annex No. 1.1. to the SWZ. The Contracting Authority envisages in this procedure the award of a basic (guaranteed) contract and possible contracts under the Right of Option. Information on the scope of the contract covered by the Right of Option, including the scope, deadline for exercising this right by the Contracting Authority and the rules under which it will be exercised, is described in Annex No. 4 to the SWZ. The Right of Option is the right of the Contracting Authority, which it may, but does not have to, exercise within the framework of this procedure. The Contracting Authority does not incur any liability for not directing such a request to the Contractor, and the Contractors are not entitled to any claim for the Contracting Authority not exercising the Right of Option. The circumstances of exercising the option are described in § 3 of Annex No. 4 to the SWZ. Whenever in this SWZ the subject of the contract is described with reference to trade marks, patents or origin, source or a particular process, which characterises the products supplied by a specific Contractor, if this could lead to the favouring or elimination of certain Contractors or products, it is assumed that such indications are accompanied by the words "or equivalent". The Contracting Authority, when describing the subject of the contract, on the basis of the provision expressed in Article 99(4) of the PPA, indicated a trade mark or origin due to the specificity of the subject of the contract and the impossibility of describing it exhaustively using precise and understandable terms. By describing the subject of the contract using trade marks, patents or origin, source or a particular process, which characterises the products supplied, the Contracting Authority thereby defines the qualitative, technical and functional features to which the subject of the contract must conform in order to meet the requirements set by the Contracting Authority. The subject of the contract should meet the technical, functional and qualitative parameters specified by the Contracting Authority in the description of the subject of the contract, which is Annex No. 5 to the SWZ. The Contracting Authority does not reserve the right to apply for the award of the contract exclusively by Contractors referred to in Article 94(1) of the PPA, i.e. having the status of a protected employment establishment, social cooperatives and other Contractors, the main aim or main aim of the activity of their organisationally separate units, which will implement the contract, is the social and vocational integration of socially marginalised persons. The procedure is conducted in the Polish language in electronic form via platformazakupowa.pl at the address https://platformazakupowa.pl/pn/ozgst. The Contracting Authority informs that the instructions for using platformazakupowa.pl, concerning in particular logging in, submitting applications for clarification of the content of the SWZ, submitting tenders and other actions taken in this procedure using platformazakupowa.pl, are available in the "Instructions for Contractors" tab on the website at the address: https://platformazakupowa.pl/strona/45-instrukcje.
