Description

The subject of the procurement is: Conservation and maintenance of traffic lights on regional roads in the Mazowieckie Voivodeship in the years 2027-2029 – procedure number 142/26

2. A detailed description of the subject of the Procurement is provided in Section IV of the SWZ – Description of the Subject of the Procurement (OPZ - Section IV of the SWZ) and in the tender cost estimate (Section V of the SWZ).

3. The contracting authority has assumed, for the purpose of comparing offers, 186 points in the tender cost estimate for the conservation and maintenance of traffic lights.

4. The contracting authority anticipates changes in the number of traffic light objects covered by maintenance during the contract period (both reductions and increases). The contractor will cover the new traffic light objects with maintenance from the date indicated by the contracting authority.

5. The execution of works in the road lane requiring a change in traffic organization is possible based on the simplified traffic organization schemes and work safeguards provided for the duration of the works related to the current maintenance of regional roads – Annex No. 2 to the OPZ. The above-mentioned schemes, due to their validity period, will be provided to the contractor by the contracting authority together with their current approval, each year of the contract duration. The contracting authority reserves the right to require the development of a traffic organization project, the scope of which will cover a larger scope than the typical schemes presented in the above-mentioned annex to the OPZ. In the scope not provided for in the above-mentioned annex, the contractor is obliged to develop, agree and obtain approval for the traffic organization project and update it according to needs throughout the contract period. The possibility of changing the traffic organization based on the traffic organization project and its deadline must be agreed each time with the relevant representative of the Road District, with whom a protocol of the change introduction must be drawn up.

6. The contracting authority does not allow the submission of partial offers. The contracting authority has not divided the procurement into parts, as the subject of the procurement covers a comprehensive service of conservation and maintenance of traffic lights located on regional roads in the Mazowieckie Voivodeship. The service requires a uniform method of organization, coordination and management. All devices covered by the procurement form elements of one road traffic safety system and their proper functioning has a direct impact on the safety of road users and traffic flow.

7. The contracting authority intends to award contracts, as referred to in Article 214(1)(7) of the PZP Act, for the total net value of: 1 707 660,38 zł. Within the framework of a similar contract, the execution of services related to the maintenance or conservation of traffic lights on the roads of the Mazowieckie Voivodeship is envisaged.

8. The contractor should have insurance (OC) for damages caused during the execution of the contract in the subject of the contract and to third parties for the entire period of the contract and for a guarantee amount not lower than 500 000,00 zł gross. The contractor is obliged to provide the contracting authority with a copy of the current and paid policy within 14 days from the date of conclusion of the contract. Provided that the insurance is continuous, the contracting authority allows the possibility of presenting several policies during the contract period confirming the possession of insurance (OC) covering the entire contract period. The contractor is obliged to provide the contracting authority with a copy of the next current and paid policy within 7 days from the expiry of the validity period of the previous policy. If the contractor fails to comply with the above obligation, the contracting authority will charge the contractor contractual penalties for delay in the amount specified in the contract. In the event of failure to submit a copy of the current and paid insurance policy (OC) within 14 days from the date of conclusion of the contract, the contracting authority will have the right to withdraw from the contract for reasons attributable to the contractor.

9. The contract execution period: 3 years from 01.01.2027.

8. The contractor whose offer is selected as the most advantageous will provide a guarantee of proper contract performance in the amount of 5% of the total price given in the offer. The requirements regarding the guarantee of proper contract performance are described in Section XX of Part I of the SWZ.

9. The contracting authority intends to apply the so-called reverse procedure, as referred to in Article 139(1) of the PZP Act, i.e. the contracting authority will first carry out an examination and evaluation of offers, and then carry out a subject qualification of the contractor whose offer was the highest rated, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure.

10. In accordance with Article 257 of the PZP, the contracting authority envisages the possibility of invalidating the subject of the procedure if the public funds which the contracting authority intended to allocate for the financing of the whole or part of the procurement have not been granted to it.

11. In the event of the indication in the description of the subject of the procurement of trademarks, patents or origin, source or special process, which characterizes the product or services provided by a specific contractor, the contracting authority allows equivalent solutions. In the event of reference in the description of the subject of the procurement to standards, European technical assessments, approvals, technical specifications and technical reference systems, the contracting authority allows equivalent solutions to those described.
