Zamowienie on the subject is the provision of a long-term loan in the amount of 3 407 368,00 PLN for the Municipality of Lubaczów, hereinafter referred to as the Contracting Authority, with the following characteristics: a) Loan amount 3 407 368,00 PLN (in words: three million four hundred seven thousand three hundred sixty-eight zlotys 00/100). The loan will be disbursed in Polish zlotys (PLN), in a non-cash form through the implementation of the Contracting Authority's disposal b) Purpose of the loan: • repayment of previously incurred liabilities under loans and advances in the amount of 1 964 088,00 PLN, • financing the planned deficit in the amount of 1 443 280,00 PLN. c) Loan period: from the date of conclusion of the contract until 31.12.2038. d) The security for the repayment of the loan will be exclusively a blank promissory note together with a promissory note declaration, with the countersignature of the Municipality Treasurer on these documents. 3.1. Detailed Description of the Subject of the Contract (DOSZ) which is Annex 1 to this specification 3.2. Projected provisions of the contract in the matter of public procurement are Annex 7. Projected provisions of the contract in the matter of public procurement, which will be introduced into the contract. 1. The contract in the matter of public procurement in accordance with the projected provisions of the contract attached to the SWZ will be concluded with the Contractor, whose offer was selected as the most advantageous. The contract conclusion date will be provided by the Contracting Authority. 2. The possibilities of changing the concluded contract and the conditions of such changes have been specified in the projected provisions of the contract in the matter of public procurement. Description of the method of preparing the offer. 1. The Contractor may submit one offer. 2. The offer must meet the following requirements: a) it must be prepared in Polish in electronic form in a data format consistent with the formats specified in the Regulation of the President of the Council of Ministers of 30 December 2020 on the manner of preparing and transmitting information and technical requirements for electronic documents and electronic communication means in the procedure for granting a public contract or tender – it is recommended to prepare the offer in .doc, .docx, .pdf formats. The offer must be submitted, under pain of invalidity, in electronic form, i.e. in electronic form with a qualified electronic signature by the authorized person/s. By the authorized person/s, we mean respectively: b) a person/people who, in accordance with the relevant provisions, is/are authorized to make declarations of will in the scope of the Contractor's property rights and obligations; c) the Contractor's proxy/ies, to whom the proxy/ies was/were granted by the person/people referred to in lit. a); d) the proxy appointed by the Contractors jointly applying for the grant of the contract. e) documents and/or declarations prepared in a foreign language must be submitted together with their translation into Polish. 3. The Contractor may change the graphic form of the templates of the annexes to the SWZ and other forms of the Contracting Authority, however, the content contained in the Contracting Authority's templates may not be changed. 4. The Contractor may submit only one offer. Offers must be submitted, under pain of invalidity, in electronic form. 5. The content of the offer must correspond to the content of the SWZ. 6. The offer is prepared in Polish on the Offer Form - in accordance with Annex 2 to the SWZ 7. The offer must include: 1) completed OFFER form - must be submitted in electronic form, i.e. sent in electronic form and with a qualified electronic signature; 2) completed JEDZ for the Contractor and the resource provider - must be submitted in electronic form, i.e. sent in electronic form and with a qualified electronic signature; 3) the commitment of the resource provider or other document (if applicable) – must be submitted in electronic form, i.e. sent in electronic form and with a qualified electronic signature; 4) a declaration of non-exclusion regarding the grounds for exclusion under Art. 5k of Regulation 833/2014, 5) a declaration of non-exclusion regarding the grounds for exclusion under Art. 5k of Regulation 833/2014 - a declaration of the resource provider, if applicable (if applicable), 6) document/s confirming the authorization to represent the Contractor and/or the resource provider in order to confirm that the person acting on behalf of the Contractor and/or the resource provider is authorized to represent him: a) a copy or information from the National Court Register or from the Central Register and Information on Economic Activity or from another relevant register. The Contractor is not obliged to submit the aforementioned documents if the Contracting Authority can obtain them through free and publicly available databases, provided that the Contractor and/or the resource provider indicates the data enabling access to these documents (in the OFFER form and/or the resource provider's commitment printout) and with the reservation of ppkt. b) b) if a person acts on behalf of the contractor and/or the resource provider, whose authorization to represent him does not result from the documents referred to in ppkt. a), the Contracting Authority requires the Contractor to provide a power of attorney or other document confirming the authorization to represent the Contractor and/or the resource provider, c) power of attorney – if required to represent the Contractor/Contractors in the case where: - the Contractor is represented by a proxy, - the offer is submitted by Contractors jointly applying for the grant of a public contract with the content required by Art. 58 sec. 2 Pzp (also applies to partners of a civil law partnership), - the authorization does not result from ppkt 7 a) and b) must be submitted in electronic form, i.e. sent in electronic form and with a qualified electronic signature.
