Zamowienie on the subject is the implementation of the task entitled: Selection of a bank to grant and service a long-term loan up to 17 447 714,53 zł (in words: seventeen million four hundred forty-seven thousand seven hundred fourteen złotych 53/100) to finance the planned budget deficit of the Tomaszowski County and to repay previously incurred liabilities. The ordering party reserves the right to take out a loan in an amount less than specified in this order and to repay the loan earlier, without incurring additional costs for this purpose. The ordering party reserves the right to not use the full amount of the granted loan - in accordance with art. 433 point 4) of the Pzp Act. The ordering party informs that the minimum loan amount that the ordering party undertakes to activate is 50,000.00 zł (in words: fifty thousand złotych 00/100). 1) Planned loan drawdown date – November 2026. 2) The contractor is obliged to activate the loan, successively transferring funds in tranches, on the written instructions of the ordering party, submitted with a ……. day advance (the loan activation date, loan tranche, is a criterion for evaluating offers). The loan will be activated no later than by 31.12.2026. 3) The contractor will not charge a commission for activating the loan and activating individual tranches. 4) The ordering party does not allow the contractor to charge any additional fees and bank commissions from the unused part of the loan. 5) Grace period for repayment of loan principal: until April 2027. 6) Expected loan repayment: a) from May 2027 to March 2043 in 191 equal monthly instalments of 90,873.00 zł, and a final equalising instalment of 90,971.53 zł payable by 30 April 2043. 7) Loan instalments payable on the interest payment date – by the last working day of each month. 8) Interest calculated in monthly interest cycles in accordance with the applicable interest rates. The number of days actually occurring in the given year is taken into account to calculate the interest amount. 9) Interest calculated on the actual loan amount drawn down from the remaining debt to be repaid. 10) Interest will be repaid from the date of loan activation. 11) For the purpose of comparing offers: - the offer price (cost of the loan) should be calculated based on the WIBOR 1 M rate of 3.79% as of 17.07.2026. - it is assumed that the loan will be activated once on 05.11.2026. 12) Form of loan security - blank promissory note. The treasurer will not affix a countersignature on the blank promissory note. The treasurer's countersignature will be made on the loan agreement and on the promissory note declaration. 13) The ordering party does not allow loan repayment to be secured in the form of a declaration of submission to enforcement under art. 777 of the Civil Code. 14) The ordering party reserves the right to make an early repayment of the capital before the end of the loan period, i.e. before the end of April 2043, as well as the possibility of repaying the capital in instalments and terms other than those presented in the repayment schedule, with the proviso that early repayment of the capital requires prior notification to the contractor. The contractor will not charge additional fees or commissions for the above actions. 15) The ordering party reserves the right to extend the loan repayment period without incurring fees and commissions. 1) A detailed description of the subject of the order and the conditions for its implementation is also described in the Essential Terms of the Contract.
