See subject of this order is the implementation of Contract 1 in the "build" formula, i.e. comprehensive execution of drilling and geological works (drilling, casing, cementing, armoring) for the Kutno GT-1 and Kutno GT-2 wells based on the Geological Works Projects (PRG) and STWiORB provided by the Contracting Authority, as well as the development of the Plan of Movement of the Geological Works Enterprise, mobilization and demobilization of the drilling equipment along with the accompanying infrastructure, carrying out hydrogeological tests, and full demobilization of the base, well and final reclamation of the area after completion of the works. The subject of the order has been divided into a Guaranteed Scope and an Optional Scope and will be implemented in stages, in accordance with the material and technological division specified in detail in point 1.1 of STWiORB and in § 1, paragraph 5 of the Draft Contract Terms (PPU - Part II SWZ). The Guaranteed Scope is the comprehensive execution of drilling and geological works for the Kutno GT-1 well and the Kutno GT-2 well in the construction variant providing for the diameter of the casing and filter pipes in Variant II, indicated in the PRG for the drilling of the Kutno GT-2 well, in accordance with the provisions of the Geological Works Projects (PRG), STWiORB and the Material-Financial Schedule (HRF). Within Stage I of the Guaranteed Scope, the construction and assembly of the Thermal Water Discharge Reservoir is also included, in accordance with the valuation included in the Offer Form. On the other hand, the Optional Scope is the unilateral entitlement of the Contracting Authority (option right) to decide, based on art. 441 of the Pzp Act, to change the construction of the Kutno GT-2 well, which involves an absolute resignation from the implementation of Variant II provided for in the Guaranteed Scope described in the PRG and the implementation of Variant I of the construction of the Kutno GT-2 well described in the PRG, which results in an appropriate change in the remuneration of the Contractor on a balanced (differential) basis specified in the Contract. The right to initiate the Optional Scope may be exercised by the Contracting Authority during the implementation of the Contract, within the deadlines indicated in the Contract. The Contracting Authority also reserves the right to unilaterally limit the Subject of the Contract (including to resign from the implementation of the Kutno GT-2 well or to resign from individual optional/conditional tests, measurements and works) on the basis specified in § 16a of the PPU, with the effect of an appropriate reduction in the remuneration of the Contractor exclusively to the value of the works actually and properly performed.
