Poola – Loodusriskide või looduslike ohutegurite vastased kaitseteenused – „Utrzymanie zbiorników wodnych na terenie Zarządu Zlewni w Piotrkowie Trybunalskim w latach 2027/2028”

Zamowienie on the maintenance and current servicing of water reservoirs in the area of operation of the Piotrków Trybunalski Basin Management in 2027/2028 (removal of moss, monitoring and servicing, replenishment of prohibition signs and information boards, removal of blockages within the reservoir, etc.) – divided into 9 parts. 1.1 Detailed description of the subject of the order contains Annexes from no. 1.1 to no. 1.9 (description of the subject of the order for each part of the basic order and planned within the framework of the option right) SWZ, and annexes from no. 2.1 to no. 2.9 (price offer form for each part of the order). 1.2 The order is carried out within the framework of the option right in each part, it will consist in repeating the same activities as those provided within the framework of the basic order. 1.3 The contractor is responsible for carrying out the work in accordance with the contract and OPZ. During the execution of the work, the recommendations of the person appointed to supervise the work, indicated by the ordering party, must be followed. 1.4 Detailed descriptions of the subject of the order are separated for each part of the order, contain Descriptions of the Subject of the Order (Annexes 1.1 – 1.9), Price Offer Forms (Annexes 2.1 – 2.9) and common for all parts of the order projected contract clauses (Annex no. 6). Descriptions of the subject of the order have been prepared separately for each part, contain information on the detailed location, scope and conditions for the performance of the task together with excerpts from overview maps indicating the locations of individual tasks. 1.5 The offer price forms have been prepared separately for each part 1.6 In accordance with art. 91 sec. 3 Pzp the ordering party informs that the contractor may submit an offer in relation to a maximum of 5 parts of the order. The ordering party has determined the number of parts of the order, to which one contractor may submit an offer, in order to ensure that one and the same contractor will not perform the entire order. In the event of submitting an offer in relation to a greater number of parts than the limit provided for by the ordering party, all partial offers are subject to rejection due to the non-compliance of the content of the offer with the conditions of the order (art. 226 sec. 1 pt. 5 Pzp). 1.7 Certificate. The subjective evidential means indicated in point 10.3 and 10.4 may be replaced by a valid certificate of the contractor of public orders, referred to in art. 124 sec. 2 of the Pzp Act, exclusively to the extent to which the certificate confirms the absence of grounds for exclusion or the fulfilment of the conditions of participation in the procedure in the scope corresponding to the requirements specified in the SWZ. The certificate does not replace the subjective evidential means concerning the grounds for exclusion not covered by the certification, in particular art. 108 sec. 1 pt 6 of the Pzp Act, art. 5k of the Council (EU) Regulation No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU No L 229), art. 7 sec. 1 of the Act of 13 April 2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, as well as the circumstances that have arisen in the course of this procedure. The certificate replaces the subjective evidential means exclusively in the scope covered by the valid certification and indicated by the contractor in the declaration contained in Annex no. 2 to the SWZ. If the certificate covers only part of the grounds for exclusion or part of the condition of participation in the procedure, or confirms the fulfilment of the condition at a lower level than required in the SWZ, the contractor submits the subjective evidential means in the remaining scope. In the scope resulting from the valid certificate, the ordering party does not require the contractor to provide other subjective evidential means, with the reservation of art. 124 sec. 4 of the Pzp Act and art. 31 sec. 6 of the Act on the certification of contractors of public orders. In accordance with art. 125 sec. 1 of the Pzp Act, the ordering party, before selecting the most advantageous offer, will call on the contractor, whose offer has been most highly evaluated, to submit, within a specified period, not shorter than 10 days from the date of the call, the current as of the date of submission of the subjective evidential means indicated in point 10.5.1, to the extent to which they have not been replaced by a valid certificate of the contractor of public orders, with regard to points 10.7.5–10.7.11 below. If it follows from the declaration (Annex no. 2 to the SWZ) that the contractor will use a certificate, and the contractor has provided the data required by art. 124 of the Pzp Act, the ordering party will independently verify the certificate in the certification database and will not call the contractor to submit the subjective evidential means to the extent to which the circumstances required by the ordering party result from that certificate. If the certificate does not cover all the circumstances required by the ordering party, the ordering party will call the contractor to submit the subjective evidential means exclusively in the scope not covered by the certification. If the data provided by the contractor do not allow the certificate to be found or verified in the certification database, the ordering party may call the contractor to submit, supplement, correct or explain those data in accordance with the provisions of art. 128 sec. 1 or 4 of the Pzp Act. If, despite the call, the ordering party is unable to verify the certificate, the certificate will not be taken into account to the extent to which it cannot be verified. If the data necessary to assess the circumstances confirmed by the certificate have not been disclosed in the certificate or in the certification database due to their legally protected nature, the ordering party may require the contractor to make those data available or to express consent to their being made available to the ordering party by the certifying entity, on
