OBJECTIVE

The objective of this contract is to provide comprehensive insurance coverage for the property portfolio of the contracting authority, which includes residential, commercial and industrial buildings, as well as infrastructure and public spaces.

The insurance coverage shall include, but not be limited to, the following risks:

- Fire, explosion and smoke damage

- Water damage

- Theft, vandalism and malicious damage

- Natural disasters (e.g. storms, floods, earthquakes)

- Liability for property damage

- Liability for bodily injury

- Business interruption

- Legal expenses

The insurance coverage shall be valid for a period of 12 months, with the option to renew for up to 36 months. The insurance coverage shall be effective from the date of the contract signature.

The contracting authority reserves the right to amend the scope of the insurance coverage during the contract period, subject to mutual agreement with the insurer.

The insurance coverage shall be provided by an insurer authorized to operate in the European Economic Area (EEA).

The contracting authority shall provide the insurer with all relevant information and documentation necessary to assess the risks and determine the insurance premium.

The insurer shall provide the contracting authority with a certificate of insurance upon request.

The contracting authority shall pay the insurance premium in accordance with the payment terms agreed in the contract.

The insurer shall indemnify the contracting authority for any losses or damages covered by the insurance policy, in accordance with the terms and conditions of the policy.

The contracting authority shall notify the insurer immediately in case of any loss or damage that may give rise to a claim under the insurance policy.

The insurer shall appoint a loss adjuster to assess the loss or damage and determine the extent of the insurer's liability.

The contracting authority shall cooperate with the loss adjuster and provide all necessary assistance to facilitate the claims process.

The contracting authority shall take all reasonable steps to mitigate any loss or damage and prevent any further loss or damage from occurring.

The contracting authority shall not be liable for any loss or damage caused by its own negligence or that of its employees, agents or subcontractors.

The insurer shall not be liable for any loss or damage caused by war, nuclear reaction, nuclear radiation or contamination by nuclear fuel or waste, or any other risks excluded under the insurance policy.

The contracting authority and the insurer shall comply with all applicable laws and regulations, including but not limited to, data protection regulations.

The contracting authority and the insurer shall maintain confidentiality with respect to all information exchanged between them, except as required by law or with the prior written consent of the other party.

The contracting authority and the insurer shall cooperate in good faith and act in accordance with the principles of fair dealing and mutual respect.

The contracting authority and the insurer shall resolve any disputes arising under the contract through negotiation, mediation or arbitration, in accordance with the dispute resolution procedure agreed in the contract.

The contracting authority and the insurer shall be liable for any breach of contract, negligence or other wrongful act or omission, in accordance with the terms and conditions of the contract.

The contracting authority and the insurer shall indemnify each other against any claims, losses, damages, liabilities, costs and expenses arising from any breach of contract, negligence or other wrongful act or omission, in accordance with the terms and conditions of the contract.
