Kohde on public procurement is the delivery of subscriptions and the provision of technical support for Cisco manufacturer devices, where all required products and the duration of support provision are specified in Annex 2 of the Tender Documentation - Price List. Further specifications of the subject of the public procurement are given in the draft contract, which forms Annex 1 of the Tender Documentation. Since the procurer has HW resources and SW resources (licenses with support for HW resources) from the manufacturer Cisco, and the SW resources will lose their validity in the future and without them the HW resources cannot be used further and the transition to other HW and SW resources would entail disproportionately high costs for the procurer, the procurer considers it justified in this case for the subject of the public procurement to refer to a certain product, resp. to SW resources - license / subscription and support of a specific manufacturer, the procurement of which is the subject of this public procurement. The procurer has not proceeded to divide the public procurement into parts, since the subject of the public procurement forms a single functional unit and is procured in a temporal context.
