Spitalul Clinic Județean de Urgență Brașov, is an public health unit with legal personality, under the jurisdiction of the Consiliului Județean Brașov, with the object of providing emergency medical services and carries out its activities in accordance with the provisions of Law 95/2006 on reform in the health field, with subsequent amendments and additions. In the context of this procedure, Spitalul Clinic Județean de Urgență Brașov fulfills the role of Contracting Authority, and Contracting Authority within the Contract. For the purpose of this section of the Award Documentation, any activity described in a particular chapter of the Book of Tasks and not explicitly specified in another chapter, should be interpreted as mentioned in all chapters where it is considered by the Tenderer that it should have been mentioned to ensure the fulfillment of the Contract Object. The products that are the subject of this procurement are Reactivi și consumabile Anatomie Patologică și Medicina Legală SUPLIMENTARĂ for the diagnosis of patients, the identification of risk factors for certain conditions, and the monitoring of the evolution of pathological states, used within the hospital sections. Given that the number of patients requiring treatment is variable, and the quantities of reactives and consumables that will be procured are not known at this time, a framework agreement has been chosen. This allows the contracting authority to award subsequent contracts, monthly or quarterly, depending on the concrete needs for products and the funds that will be allocated for their procurement (own revenues). The total estimated value without VAT is 7,534,411.20 lei. The minimum and maximum estimated quantities of the framework agreement can be found in the Book of Tasks on pages 5-22. The minimum and maximum estimated quantities that are the subject of the framework agreement, as well as those that are the subject of the largest subsequent contract, can be found in the Book of Tasks, point 3.1. The requirements imposed are minimum and mandatory. An offer that does not comply with the mandatory requirements provided for in the Book of Tasks will be considered non-compliant and will be rejected. Technical specifications that indicate a particular manufacturer, a particular origin or a particular process or that refer to brands, patents, types, to an origin or to a specific production or to standards are mentioned only for the easy identification of the characteristics of the products to be procured and DO NOT have the effect of favoring or eliminating certain economic operators. These specifications will always be considered as having the mention « or equivalent ». A framework agreement will be concluded for a period of 24 months. The deadline by which economic operators can request clarifications or additional information regarding the award documentation is 18 days before the deadline for submission of tenders. The contracting authority will respond, clearly and completely, to all requests for clarifications/additional information by the 11th day before the deadline for submission of tenders.
