Lengyelország – Rádió-távbeszélő, rádiótávíró, illetve rádiós és televíziós műsorszórási adóberendezések – Dostawy radiosterowań po sieci LAN do radiotelefonów VHF i UHF oraz konsol dyspozytorskich

1. A tender procedure is being conducted for the conclusion of a framework agreement for the supply of LAN network radiotelephones to VHF and UHF radiotelephones and dispatcher consoles, hereinafter referred to as the "SWZ assortment". 2. A detailed description of the subject of the order is Annex No. 5 to the SWZ and Section XIX/XIXa of the SWZ. 3. The Contractor shall be obliged to provide a minimum 24-month warranty and guarantee for the supplied assortment, calculated from the date of signing by the Parties without remarks in the quantitative acceptance protocol. The warranty period cannot be shorter than the guarantee period. 4. The Purchaser does not require the submission of subject matter evidence with the offer. 5. The Purchaser does not allow partial offers to be submitted. 6. The Purchaser allows the assignment of part of the order to a Subcontractor. 7. The Purchaser requires the Contractor to indicate in the offer which part of the order will be assigned to Subcontractors and to provide the names of any Subcontractors, if known. 8. Delivery deadline for the assortment: within 45 working days, from the date of signing the contract or the acceptance of the request. 9. Binding offer deadline: 27.01.2027. 10. The Purchaser will make changes to the contract in accordance with Section XIX and XIXa of the SWZ. 11. Pursuant to Article 13(1) and (2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: "GDPR"), the Purchaser informs that: 1) the administrator of your personal data is the Chief of the Capital Police; 2) the supervision over the proper processing of personal data is exercised by the data protection inspector: address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: [email protected] 3) your personal data will be processed on the basis of Article 6(1)(c) of the GDPR for the purpose related to the procedure conducted in the open tender procedure for the conclusion of a framework agreement for the supply of LAN network radiotelephones to VHF and UHF radiotelephones and dispatcher consoles (Procedure Number: WZP-2588/26/144/Ł). 4) the recipients of your personal data will be persons or entities to whom the documentation of the procedure will be made available on the basis of Article 18 and Article 74(1) of the Act; 5) your personal data will be stored in accordance with Article 78 of the Act for a period of 4 years from the date of completion of the procedure for the award of the order, and if the duration of the contract exceeds 4 years, the storage period will cover the entire duration of the contract; 6) the obligation to provide your personal data directly related to you is a legal requirement specified in the provisions of the Act, related to participation in the procedure for the award of a public order; the consequences of not providing the specified data result from the Act; 7) in relation to your personal data, decisions will not be made in an automated manner, in accordance with Article 22 of the GDPR; 8) you have: a) the right to access your personal data under Article 15 of the GDPR; b) the right to rectify your personal data under Article 16 of the GDPR; c) the right to request the administrator to restrict the processing of personal data with the reservation of cases referred to in Article 18(2) of the GDPR; d) the right to lodge a complaint with the President of the Personal Data Protection Office, if you consider that the processing of your personal data violates the provisions of the GDPR; 9) you do not have: a) the right to erasure of personal data under Article 17(3)(b), (d) or (e) of the GDPR; b) the right to data portability under Article 20 of the GDPR; c) the right to object under Article 21 of the GDPR, to the processing of personal data, as the legal basis for the processing of your personal data is Article 6(1)(b), (c) and (f) of the GDPR. 12. The Purchaser does not require the Contractor to demonstrate compliance with the conditions specified in Article 112(2) of the Act. 13. The subject order may be applied for by Contractors who are not excluded on the basis of Article 108(1) of the Act, Article 109(1)(1-10) of the Act, and Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving the protection of national security (Journal of Laws of 2025, item 514) and Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 229 of 31.7.2014, p. 1) as amended, hereinafter: Regulation 833/2014, in the wording given by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 111 of 8.4.2022 p. 1) and as amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine.
