**Description of the procurement:**

The contracting authority intends to conclude a framework agreement for the supply of poultry-based products, either raw, cut or processed, in a refrigerated state. The products must meet the following specifications:

1. **Product types:** The products must be of the following types: whole chickens, chicken breasts, chicken thighs, chicken wings, and chicken drumsticks. Other poultry products may be accepted if they meet the required specifications.

2. **Origin:** The products must originate from countries that are members of the European Union or from third countries that have been approved by the European Commission for the export of poultry products to the EU.

3. **Quality:** The products must comply with the relevant EU regulations and standards, including but not limited to, the following:

- Commission Regulation (EC) No 566/2008 of 18 June 2008 implementing Regulation (EC) No 852/2004 of the European Parliament and of the Council on the hygiene of foodstuffs.

- Commission Regulation (EC) No 853/2004 of 29 April 2004 laying down specific hygiene rules for food of animal origin.

- Commission Regulation (EC) No 854/2004 of 29 April 2004 laying down specific rules for the organisation of official controls on products of animal origin intended for human consumption.

4. **Packaging:** The products must be packaged in accordance with the relevant EU regulations and standards, and must be clearly labelled with the following information:

- Product name and description.

- Net weight.

- Best before date.

- Lot number.

- Country of origin.

- Name and address of the manufacturer or packer.

5. **Delivery:** The products must be delivered to the contracting authority's premises in Brussels, Belgium, within the agreed delivery times and in accordance with the agreed delivery schedule.

6. **Payment terms:** Payment will be made within 30 days of receipt of the invoice and delivery of the products.

7. **Contract duration:** The framework agreement will have a duration of 48 months, with the possibility of extension for an additional 24 months.

8. **Minimum and maximum quantity:** The minimum quantity to be supplied under the framework agreement is 10 000 kg, and the maximum quantity is 50 000 kg.

9. **Pricing:** Prices must be expressed in EUR, excluding VAT, and must include all costs related to the supply of the products, including delivery to the contracting authority's premises in Brussels, Belgium.

10. **Tender evaluation criteria:** Tenders will be evaluated based on the following criteria:

- Price (40%).

- Quality of the products (30%).

- Delivery times and schedule (20%).

- Experience and references (10%).

**Tender submission:**

Tenders must be submitted electronically via the eTendering platform, following the instructions provided in the tender documentation.

**Tender opening:**

The deadline for the submission of tenders is 17/08/2023 at 12:00 (CET). Late tenders will not be accepted.

**Tender evaluation:**

The evaluation of tenders will commence immediately after the deadline for submission of tenders. The contracting authority reserves the right to reject any or all tenders if they do not meet the required specifications or if they are not in the best interest of the contracting authority.

**Contract award:**

The contract will be awarded to the tenderer who submits the most economically advantageous tender, as determined by the evaluation criteria set out above. The contracting authority reserves the right to negotiate with the successful tenderer prior to the award of the contract.

**Contract performance:**

The successful tenderer will be required to comply with the terms and conditions set out in the framework agreement, including but not limited to, the following:

- Delivery of the products in accordance with the agreed delivery times and schedule.

- Compliance with the relevant EU regulations and standards.

- Maintenance of the required quality and safety standards.

**Contract completion:**

The framework agreement will be completed upon the expiry of the contract duration or upon early termination by the contracting authority in accordance with the terms and conditions set out in the framework agreement.
