Šī public procurement procedure is directed to the creation of a Dynamic Procurement System (hereinafter: DPS) for MÁV Személyszállítási Zrt. for a period of 60 months for the procurement of materials needed for the maintenance and/or repair of buildings and structures. Any economic operator that meets the suitability criteria defined by the entity issuing the invitation to tender may join the DPS at any time during its entire duration, with the proviso that the possibility of submitting a new participation declaration arises after the deadline for submitting the first participation declaration has expired, and after the date of sending the summary of the evaluation of the participation declarations. The entity issuing the invitation to tender, in accordance with the provisions of the Kbt. 107. § (2), shall, in the course of implementing the DPS, provide the precise technical description and contractual terms for the specific public procurements to be implemented in the system, to those who have submitted a valid participation declaration in the DPS, simultaneously with the sending of the invitation to tender. The entity issuing the invitation to tender, in the second, tendering phase of the procedure, is entitled to determine the tender submission deadline in the individual invitations to tender for a minimum of 5 calendar days. The participant must declare in the participation declaration that they accept the tender submission deadline of at least 5 calendar days. If all participants admitted to the DPS accept the provisions relating to the tender submission deadline, then, in accordance with the provisions of the Kbt. 84. § (6), it is to be considered that an agreement has been reached and the entity issuing the invitation to tender is entitled to determine a tender submission deadline of at least 5 calendar days in all invitations to tender, with the proviso that the tender submission deadline may be extended in justified cases and in accordance with the provisions of the Kbt. If any economic operator does not accept the above, the entity issuing the invitation to tender is obliged to determine a tender submission deadline of at least 10 calendar days, with the proviso that this does not prevent the entity issuing the invitation to tender and the participants from agreeing on a shorter period during the duration of the DPS. In the second, tendering phase of the procedure, the participant/tenderer must submit the further documents and declarations specified in the procurement documents and technical description issued in the tendering phase, as well as those prescribed by the Kbt. or the relevant legal provisions. The participant must declare, for the validity of the participation declaration, that they accept the general contractual terms issued by the entity issuing the invitation to tender as part of the other procurement documents in the invitation to participate. Following the successful completion of the participation phase of this procedure, and upon the emergence of a specific procurement need, the entity issuing the invitation to tender sends the invitation to tender to the participants deemed suitable via the EKR. All necessary information relating to the operation of the DPS and the rules and description of joining is contained in the procurement documents and the provisions of the Kbt. and the relevant legal provisions. Every participant who meets the suitability criteria is admitted to the DPS, and the number of participants to be invited to tender is not subject to any limitation.
