Predmet tal-każna hi l-implementazzjoni tal-etapa t-tieni ta' l-opera ROZVOJ A MODERNIZÁCIA FAKULTNEJ NEMOCNICE S POLIKLINIKOU J. A. REIMANA PREŠOV. Il-ħaġa tal-ħidma ta' l-ħidma tal-bini hi definita mill-dokumentazzjoni tal-proġett u l-summarju tal-ħidma li jidherbha għall-etapa t-tieni. Il-kondizzjonijiet tekniki u tal-kontrakt li jirriżulta mill-ħidma jkunu predmet ta' l-konferenza tal-negozjati mal-żewġin li jkunu seħħa.

1. **Technical Conditions**

1.1. **General Conditions**

1.1.1. The Contractor shall carry out the works in accordance with the Contract Documents and the applicable laws and regulations.

1.1.2. The Contractor shall comply with the health and safety requirements set out in the Contract Documents and the applicable laws and regulations.

1.1.3. The Contractor shall obtain all necessary permits and approvals required for the execution of the works.

1.2. **Specific Conditions**

1.2.1. The Contractor shall use materials and equipment that comply with the specifications set out in the Contract Documents.

1.2.2. The Contractor shall carry out the works in accordance with the methods and sequences set out in the Contract Documents.

1.2.3. The Contractor shall ensure that the works are carried out to the required quality standards and that they are fit for their intended purpose.

1.3. **Testing and Commissioning**

1.3.1. The Contractor shall carry out all necessary testing and commissioning of the works in accordance with the Contract Documents.

1.3.2. The Contractor shall provide all necessary documentation and certificates to demonstrate that the works have been completed in accordance with the Contract Documents and the applicable laws and regulations.

1.4. **Defects Liability Period**

1.4.1. The Contractor shall be responsible for any defects or faults that arise during the defects liability period.

1.4.2. The Contractor shall rectify any defects or faults that arise during the defects liability period at their own cost.

1.4.3. The defects liability period shall commence on the date of practical completion of the works and shall continue for a period of 12 months thereafter.

1.5. **Environmental Conditions**

1.5.1. The Contractor shall carry out the works in an environmentally responsible manner and in accordance with the environmental management plan set out in the Contract Documents.

1.5.2. The Contractor shall comply with all applicable environmental laws and regulations.

1.5.3. The Contractor shall obtain all necessary environmental permits and approvals required for the execution of the works.

1.6. **Sustainability Conditions**

1.6.1. The Contractor shall carry out the works in a sustainable manner and in accordance with the sustainability management plan set out in the Contract Documents.

1.6.2. The Contractor shall comply with all applicable sustainability laws and regulations.

1.6.3. The Contractor shall obtain all necessary sustainability permits and approvals required for the execution of the works.

2. **Contractual Conditions**

2.1. **Payment**

2.1.1. The Contractor shall be paid in accordance with the payment terms set out in the Contract Documents.

2.1.2. The Contractor shall submit invoices in accordance with the payment terms set out in the Contract Documents.

2.1.3. The Contractor shall be paid within 30 days of the submission of a valid invoice.

2.2. **Variations**

2.2.1. The Contractor shall be entitled to claim additional payment for any variations to the works that are instructed by the Employer.

2.2.2. The Contractor shall submit a claim for additional payment in accordance with the procedures set out in the Contract Documents.

2.2.3. The Employer shall assess the claim for additional payment and shall pay the Contractor in accordance with the assessment.

2.3. **Extensions of Time**

2.3.1. The Contractor shall be entitled to claim an extension of time for any delay to the completion of the works that is caused by the Employer or a relevant event.

2.3.2. The Contractor shall submit a claim for an extension of time in accordance with the procedures set out in the Contract Documents.

2.3.3. The Employer shall assess the claim for an extension of time and shall grant the Contractor an extension of time in accordance with the assessment.

2.4. **Liquidated Damages**

2.4.1. The Contractor shall be liable to pay liquidated damages to the Employer for any delay to the completion of the works that is caused by the Contractor.

2.4.2. The rate of liquidated damages shall be as set out in the Contract Documents.

2.4.3. The Contractor shall pay liquidated damages to the Employer within 30 days of the date of practical completion of the works.

2.5. **Termination**

2.5.1. The Employer shall be entitled to terminate the Contract in accordance with the termination provisions set out in the Contract Documents.

2.5.2. The Contractor shall be entitled to terminate the Contract in accordance with the termination provisions set out in the Contract Documents.

2.5.3. The parties shall agree the terms of any termination payment in accordance with the termination provisions set out in the Contract Documents.
