Polonia – Gaze naturale – Grupa Zakupowa NORDA. Kompleksowa dostawa gazu ziemnego w okresie od 01.01.2027r. do 31.12.2027r.

1. Contracting authorities described in Chapter I of the SWZ jointly conduct a public procurement procedure (art. 38 of the Pzp Act). The authorized contracting authority – the Group Leader – is the City of Gdynia acting through its Representative. 2. Orders will be placed by individual contracting authorities in accordance with the description in Sections III.1, III.2, III.3, III.4 of the SWZ. 3. The subject of the order is the comprehensive supply of gaseous fuel – the supply of high-methane natural gas with the symbol E together with the distribution service. 4. CPV Code: 09123000-7 – natural gas, 65210000-8 – gas transmission, 65200000-5 – gas transmission and similar services. 5. The order will be awarded in four parts: Part 1 of the order – Comprehensive supply of natural gas area PSG - tariff protection Part 2 of the order - Comprehensive supply of natural gas area PSG – no protection Part 3 of the order – Comprehensive supply of natural gas area G.EN - tariff protection Part 4 of the order - Comprehensive supply of natural gas area G.EN – no protection. The contractor may submit a bid for any number of parts. 6. Details regarding the consumption of gaseous fuel, distribution parameters in individual PPG are described in Annex No. 1a, 1b, 1c, 1d to the SWZ - List of gas reception points PPG. 7. The contracting authority informs that if the Distribution System Operator questions the tariff groups indicated in the procedure at the time of reporting the contract for implementation, the contracting authorities agree to adjust the tariff groups to those in force at the OSD. 8. Quality standards: The contracting authority informs that the quality standards for the supply of natural gas relating to all essential features of the subject of the order are described and regulated by the OSD Tariff, the Pe Act and the implementing regulations: 1) The subject of the order are comprehensive supplies of natural gas through the distribution network with specified, in accordance with the applicable regulations, quality standards together with the transmission service. Supplies and distribution services provided under a comprehensive agreement will be performed on the terms specified in the Pe Act and the implementing regulations to the Act as well as in accordance with the provisions of the OSD Tariff. 2) The quality parameters of gaseous fuels are regulated by the provisions of the Energy Law, executive acts, in particular: The Regulation of the Minister of Energy of 15 March 2018 on detailed rules for shaping and calculating tariffs as well as settlements in the trade of gaseous fuels, amended by the Regulation of the Minister of Climate and Environment of 23 November 2023 amending the regulation on detailed rules for shaping and calculating tariffs as well as settlements in the trade of gaseous fuels, the Regulation of the Minister of Economy of 02 July 2010 on detailed conditions for the functioning of the gas system with later amendments as well as Polish Standards. 3) The tariff for the distribution of gaseous fuels (approved by the President of URE) 10. The contractor, based on the granted Power of Attorney, will be obliged to report the contract to the OSD on behalf of itself and the contracting authorities (recipients) in accordance with the applicable regulations and to represent them before the OSD in the process of changing the seller. 11. The contracting authority will apply art. 139 para. 1 of the Pzp Act, i.e., first, it will conduct an examination and evaluation of offers, and then it will qualify the contractor whose offer was the highest rated, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. 12. The condition for starting comprehensive supplies within the contractual deadlines will be the successful completion of the seller change procedure. The contracting authority indicates the deadline for the implementation of the order by specifying the concrete date of the start and end of the implementation of the order due to the need to maintain the continuity of supplies and transmission of gaseous fuel to the facilities, as well as due to the regulations governing the procedure for changing the seller (the need to report the date of the start and end of supplies by the given contractor). 13. Contractors who are not subject to exclusion and meet the conditions for participation in the procedure may compete for the order in the scope of: 1) entitlements to conduct a specified economic or professional activity, 2) technical or professional capacity. In the remaining scope, the contracting authority waives the determination of the conditions for participation in the procedure. 14. The contractor will meet the condition for participation in the procedure concerning entitlements to conduct economic activity if it demonstrates: 1) possession of entitlements in the scope of trade in gaseous fuels, i.e. possession of a valid Concession in the scope of trade in gaseous fuels issued by the President of the Office of Energy Regulation. (art. 32 para. 1 of the Pe Act) and 2) possession of entitlements in the scope of distribution of gaseous fuels, i.e. possession of a Concession in the scope of distribution of gaseous fuels issued by the President of the Office of Energy Regulation or (if the contractor is not the owner of the network in the area where the place of supply of natural gas is located) a valid Agreement with the Distribution System Operator for the provision of gaseous fuel distribution services, enabling the implementation of supplies to the reception points described in Annex No. 1a and/or 1b and/or 1c and/or 1d to the SWZ. (art. 32 para. 1 of the Pe Act). 15. The contractor will meet the condition for participation in the procedure concerning technical or professional capacity if it demonstrates that it has properly performed, within the last 3 years, or if the period of conducting activity is shorter, then within this period, in the scope of the amount of natural gas and the number of PPG indicated in the SWZ. 16. A detailed description of the conditions for participation, the manner of their fulfillment is in the SWZ Chapter VI. CONDITIONS FOR PARTICIPATION IN THE PROCEDURE. Description of documents to confirm fulfillment of the conditions for participation in the procedure is in the SWZ Chapter VII. EVIDENCE AND DOCUMENTS THAT CONTRACTORS ARE OBLIGED TO SUBMIT IN ORDER TO DEMONSTRATE FULFILLMENT OF THE CONDITIONS FOR PARTICIPATION IN THE PROCEDURE AND THE LACK OF GROUNDS FOR EXCLUSION.
