Procurement framework agreements for the supply of iron(III) chloride solution, necessary for the removal of phosphorus and hydrogen sulfide in wastewater treatment, and for the removal of arsenic in drinking water treatment, as well as a chemical for preventing filamentous growth and phosphorus removal for Debreceni Vízmű Zrt. 1) This procedure aims to establish the DBR. Given the estimated value of the procedure, the Second Part of the Kbt. is applied according to sections 106-107, i.e., the rules of the procurement procedure for establishing (so-called first, participation phase) and implementing (so-called second, tender phase) the dynamic procurement system (hereinafter DBR). The Inviting Party applies the rules of the invitation phase of the participation phase of the DBR for inclusion in the DBR, and the rules of the tender phase of the invitation procedure for the procurements within the DBR, with the deviations applicable to the DBR. [Kbt. 107. § (1)-(2) paragraphs]. We draw the attention of the participants that in the current first, participation phase of the DBR, the participant may not submit a tender! 2) The Inviting Party defines 2 categories (parts) in the current, participation phase of the DBR. 1. Category (part): Procurement of iron (III) chloride solution. 2. Category (part): Procurement of chemical for preventing filamentous growth. 2) The duration of the DBR: 36 months from the establishment of the DBR. Rules for participation 3) During the validity of the DBR, any economic operator (participant) who - is not subject to the exclusion grounds - meets the suitability requirements and - has submitted the participation declaration compliant with the procurement documents, may request inclusion in the system at any time. The condition for inclusion in the DBR is the submission of the participation declaration defined in the procurement documents, the prior proof of compliance with the suitability requirements, and the non-existence of the prescribed exclusion grounds. 4) The possibility of joining the DBR - by submitting a participation declaration compliant with the procurement documents - is continuous, and in the second, tender phase, all participants included in the DBR - currently valid number, for the given procurement part - may submit a tender. A) In the first, participation phase of the DBR, there is an opportunity to submit participation declarations until the participation deadline. B) After the participation deadline specified in the first, participation phase of the DBR, there is an opportunity to join (submit a participation declaration) to the already established DBR, at any time during its full validity period. 5) Therefore, those economic operators who have not submitted their participation declarations for inclusion in the DBR by the participation deadline in the first, participation phase, may do so at any time during the full validity period of the DBR, after the sending of the summary of the first, participation phase. In the case of a participation declaration submitted after the sending of the summary of the first, participation phase, it is also necessary to submit in the participation declaration all those documents whose submission is mandatory according to the invitation to participate and the participation documentation. After submitting a valid participation declaration, the late participants are included in the DBR and are only entitled to participate in the second, tender phase after inclusion. 6) We draw the attention of the participants that if they submit their participation declarations after the participation deadline for the establishment of the DBR but before the sending of the summary, their participation declaration will be considered late in this evaluation phase. In this case, the provisions of point 5) above apply. The Inviting Party sends the invitation to tender to those economic operators for the implementation of the concrete procurement needs, who have been included in the DBR. If the participant submits the participation declaration after the establishment of the DBR and the Inviting Party has not yet evaluated the declaration before sending the given invitation to tender, the Inviting Party will not send the given invitation to tender to this participant. 7) In the first, participation phase of the DBR aimed at establishing the DBR, the participants must declare in advance in their submitted participation declaration, under the "alfa" point of Chapter IV of the EEKD, their compliance with the minimum suitability requirement(s). The proofs prescribed within the minimum suitability requirement(s) do not need to be attached to the participation declaration, they must be submitted in the second, tender phase, based on the invitation of the Inviting Party according to paragraph (4) of section 69 of the Kbt. 8) We draw the attention of the participants that in the current first, participation phase of the DBR, the participant may not submit a tender! 9) In the second, tender phase of the DBR, the Inviting Party evaluates the tenders according to paragraph (2) a) of section 76 of the Kbt. based on the lowest price, taking into account that the expected quality and technical requirements are specifically defined in the procurement documents and technical descriptions of the second, tender phase, as well as in the contract drafts sent simultaneously with the invitation to tender, and in case of compliance with the conditions defined in the contract draft sent simultaneously with the invitation to tender, the product meets the requirements of the Inviting Party, further quality and technical characteristics do not influence the selection of the economically most advantageous tender. The Inviting Party defines other requirements related to the tender price in the tender phase. 10) The Inviting Party does not set a framework amount in this procedure.
