Contract framework for the supply of cast-iron brake shoes for locomotives, passenger and freight cars, up to a net framework amount of 250 000 euros. The buyer undertakes a commitment to call off a net amount of 192 500 euros from the total framework amount during the validity of the contract. Expected quantity: M284 type brake shoe: 4 035 pcs, M320F type brake shoe: 2 000 pcs, K250 type brake shoe: 8 500 pcs, K320 type brake shoe: 300 pcs. The contracting authority draws the attention of tenderers to the fact that, if the technical specification refers to a specific make or origin, or to a specific process, which characterizes the products of a given economic operator or the services provided by that operator, or refers to a trademark, patent, activity, person, type or specific origin or manufacturing process, as well as to a standard, technical approval, technical specification, technical recommendation, the mention is made only for the purpose of clearly defining the subject matter and the expression "or equivalent" must also be understood in addition to the mention. In this call for tenders and in the procurement documents, the contracting authority has provided the quantitative data in an informative manner; after the conclusion of the framework contract, the quantity of the products actually ordered may differ from these expected quantities. The contracting authority also draws the attention of T. tenderers to the fact that the data determined as expected quantities serve the comparability of the tenders, and also form the basis of the financial cover available to the contracting authority for the performance of the contract. In this respect, if the tender price formed by the unit prices (net euros/pcs) offered by the tenderer for the individual cast-iron brake shoes and the expected quantities exceeds the financial cover determined by the contracting authority during the preparation of the procedure (and verifiable in accordance with Kbt. 75. § (4) subparagraph), then the contracting authority may, with reference to Kbt. 75. § (2) subparagraph b) point, declare the given part unsuccessful.
