2. PROCEDURE FOR AWARDING THE CONTRACT

2.1. The procedure is conducted as an open tender in accordance with the provisions of the Act of 11 September 2019 - Public Procurement Law (i.e. Dz. U. z 2026 r. poz. 793 z późn. zm.; hereinafter: PZP) and the executive acts to PZP.

2.2. The procedure is conducted in accordance with the rules provided for classical procurements with a value equal to or higher than the amounts specified in the announcement of the President of the Public Procurement Office issued under art. 3 sec. 2 PZP.

2.3. The procedure will be conducted in accordance with the rules provided for the so-called "reverse order of evaluation of tenders", as mentioned in art. 139 PZP. According to the cited provisions, the Contracting Authority will first conduct an examination and evaluation of the tenders, and then conduct a subjective qualification of the Contractor whose tender was highest evaluated, in the scope of the exclusion grounds and meeting the conditions of participation in the procedure.

3. DEFINITIONS

Whenever in this SWZ there is mention of:

a) PZP - this shall mean the Act of 11 September 2019 - Public Procurement Law (i.e. Dz. U. z 2026 r. poz. 793 z późn. zm.),

b) Directive 2014/24/EU – this shall mean the Directive of the European Parliament and of the Council 2014/24/EU of 26 February 2014 on public procurement, repealing Directive 2004/18/EC (OJ EU. L. z 2014 r. Nr 94, str. 65 z późn. zm.),

c) procurement - this shall mean the public procurement to which this SWZ relates,

d) procedure - this shall mean the procedure for awarding the contract,

e) Contracting Authority – this shall mean the Contracting Authorities mentioned in sec. 1 pt. I SWZ,

f) working day - this shall mean a day which is not a day recognized by law as a non-working day or a Saturday,

g) price – this shall mean the price in the meaning of art. 3 sec. 1 pt 1 and sec. 2 of the Act of 9 May 2014 on informing about the prices of goods and services (i.e. Dz. U. z 2023 r. poz. 168), even if it is paid to a person who is not an entrepreneur,

h) Contractor – this shall mean a natural person, legal person or organizational unit not having legal personality, which offers on the market the execution of construction works or a construction object, supply of products or provision of services or applies for awarding the contract, submitted a tender or concluded an agreement in the matter of public procurement,

i) consortium – this shall mean Contractors jointly applying for awarding the contract,

j) SWZ, specification – this shall mean this specification of the contract conditions,

k) single document/JEDZ (Jednolity Europejski Dokument Zamówienia) – this shall mean the declaration submitted on the form of the single European procurement document, prepared in accordance with the standard form template specified in the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form of the single European procurement document,

l) qualified electronic signature - a signature issued by a qualified trust service provider being a subject providing certification services and based on a qualified electronic signature certificate. The electronic signature must meet the security requirements specified in the Act of 5 September 2016 on trust services and electronic identification (i.e. Dz. U. z 2024 r. poz. 1725) and Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (OJ EU. L. z 2014 r. Nr 257, str. 73 z późn. zm.; Regulation eIDAS),

m) tender – this shall mean the Tender Form submitted in electronic form together with the remaining documents required in the procedure documentation, meeting the provision of art. 78 (1) § 1 of the Act of 23 April 1964 Civil Code (i.e. Dz. U. z 2026 r. poz. 795) (c.c.) and art. 66 §1 c.c. in connection with art. 8 sec.1 and art. 63 sec. 1 and art. 218 sec. 2 PZP,

n) partial tender - this shall mean a tender providing, in accordance with the procurement documents, for the execution of part of the procurement;

o) subjective evidentiary means - this shall mean the means serving to confirm the lack of exclusion grounds or meeting the conditions of participation in the procedure, with the exception of JEDZ, PROJEKTOWANE POSTANOWIENIA UMOWY - Chapter 22 SWZ LABOUR EMPLOYMENT REQUIREMENTS - Chapter 24 SWZ OTHER INFORMATION - Chapter 25 SWZ INFORMATION OBLIGATION - Chapter 26 SWZ

4. DESCRIPTION OF THE SUBJECT OF THE PROCUREMENT

4.1. The subject of the procurement is: comprehensive implementation of the service related to the acceptance and disposal of municipal waste, named “Disposal of municipal waste from uninhabited properties in the area of the Municipality of Środa Wielkopolska in 2027”.
