2. PROCEDURE FOR AWARDING THE CONTRACT
2.1. The procedure is conducted as an unrestricted tender in accordance with art. 377, para. 1, point 1 and art. 132-139 in connection with art. 378, para. 1 of the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793 with amendments - "PZP") and the implementing acts to PZP.
2.2. The procedure is conducted in accordance with the rules provided for sectoral contracts with a value equal to or exceeding the EU thresholds.
2.3. The procedure is conducted in accordance with the rules provided for the so-called "reverse procedure", as mentioned in art. 139, para. 1, 3 and 4 PZP. According to the cited provisions, the Contracting Authority first carries out an examination and evaluation of the tenders, and then carries out a subjective qualification of the Contractor whose tender was most highly evaluated, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure.
2.4. The Contracting Authority does not envisage the selection of the most advantageous tender using an electronic auction.
2.5. The Contracting Authority does not allow the submission of variant tenders and does not envisage the conclusion of a framework agreement.
2.6. The Contracting Authority, pursuant to art. 131, para. 2, point 1 and art. 134, para. 2, point 9 of the PZP Act, requires the submission of a tender after the Contractor has carried out a local inspection of all the SUW indicated in Annex No. 4 to the contract template. The tender of a Contractor who has not carried out the required local inspection will be rejected pursuant to art. 226, para. 1, point 18 of the PZP Act. The local inspection will take place after prior agreement on the date with the Contracting Authority. The registration should be sent by email to: [email protected], indicating: 1. the name of the Contractor, 2. the first name and surname of the contact person and telephone number, 3. the first names and surnames of the persons who will participate in the local inspection. The Contracting Authority will agree with the Contractor on the date of the inspection in a way that ensures the continuity and uninterrupted operation of the facilities. The Contractor is obliged to comply with the instructions of the Contracting Authority's employees regarding the organisation of the inspection, safety and movement within the facilities. Confirmation of the local inspection will be a protocol signed by a representative of the Contractor and the Contracting Authority or a list of attendees covering all the facilities in which the inspection was conducted. During the local inspection, it is not permitted to take photographs or make audio or video recordings. The local inspection does not serve to provide explanations regarding the contents of the SWZ. Questions regarding the contract documents should be directed in the manner specified in the SWZ. The Contracting Authority reserves the right to set a common date for the inspection for several Contractors or to indicate time slots in which the inspections can be conducted. No more than 2 representatives of a given Contractor may participate in the local inspection. The Contracting Authority has decided not to divide the material scope of the contract, as all the facilities covered by it are closely interlinked, and as components of the water supply system, they must be operated by one Contractor who will take responsibility for the quality of the water supplied.
3. DESCRIPTION OF THE CONTRACT
3.1. The subject of the contract is the operation and maintenance of the technological sequence of devices forming part of the municipal water production system and the operation of the water supply network (including connections) within the municipality of Jarocin.
3.2. A detailed description of the subject of the contract is contained in the contract template constituting Annex No. 9 to the SWZ.
3.3. Common Procurement Vocabulary (CPV): 65111000-4 – Transmission of drinking water, 65130000-3 – Water station operation.
3.4. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key tasks related to the subject of the contract. The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors. In the event of an intention to carry out the subject of the contract with the involvement of subcontractors, the Contractor is obliged to indicate in his tender the part of the contract (material scopes) the implementation of which he intends to entrust to subcontractors, and to provide the names of any potential subcontractors, if they are already known. In the event of failure to indicate subcontracting in the tender, the Contractor will only be able to introduce a subcontractor on the terms specified in the contract.
3.5. The Contracting Authority requires the Contractor or subcontractor to employ, on the basis of an employment contract, persons performing activities consisting of: operating the technological sequence of devices forming part of the municipal water production system and operating the water supply network (including connections). Before concluding the contract, the Contractor undertakes to submit a written declaration in which he confirms that all persons performing activities within the scope of the implementation of the Contract, as referred to in point 3.5, will be employed, for the entire period of the performance of these activities, on the basis of an employment contract.
3.6. The producer of waste – within the meaning of the provisions of the law – is considered to be the Contractor selected as a result of this procedure.
