Economic operators submitting a tender must prove a form of registration under the law in the country of residence, from which it appears that the tenderer has activities in the field of activity, the activities which are the subject of the present contract (CAEN codes) and holds the electricity supply license issued by ANRE, in accordance with Law No. 123/2012 - art. 8 - Electricity Law. The way in which compliance with the requirement can be demonstrated: The DUAE will be completed by the operators participating in the procedure with information relating to their situation. The supporting documents proving compliance with the assumptions made by completing the DUAE will be presented, upon request by the contracting entity, only by the tenderer ranked first. Supporting documents: 1) For Romanian/foreign legal entities: Certificate of registration issued by the Trade Register / operating permit / other equivalent documents, from which it appears that the tenderer has activities in the field of activity, the activities which are the subject of the present contract (CAEN codes). By submitting the certificate of registration, the tenderer assumes responsibility for the fact that the information contained in the submitted document is valid/real at the date of submission of the document. 2) For Romanian/foreign natural persons: presentation of documents proving a form of registration / certification or professional affiliation, from which it appears that the tenderer has activities in the field of activity, the activities which are the subject of the present contract (CAEN codes). By submitting the documents, the tenderer assumes responsibility for the fact that the information contained in the submitted document is valid/real at the date of submission of the document. Documents proving a form of registration as a legal/natural person, shall be in accordance with the legal provisions in the country in which the candidate / tenderer / associate is established and shall be presented in original / legalised copy, by the tenderer, associate, subcontractor, for the part of the contract which they carry out. 3) The electricity supply license issued by ANRE, in accordance with Law No. 123/2012 - art. 8 - Electricity Law, valid at the date of submission of the document. 4) Declaration on own responsibility regarding the obligation to ensure the validity of the license issued by ANRE, for the duration of the contract.
