Section 130a (8) SGB V allows health insurers and pharmaceutical companies to conclude framework discount contracts for medicines to be dispensed at the expense of the statutory health insurers. With regard to the relevant legal provisions for the award of public contracts, a regular process of substance-related, formal tendering procedures according to the regulations of Part 4 of the GWB is carried out by DAK-Gesundheit. For medicines to be specified by the bidder in more detail in Annex 2 to the contract for the above-mentioned substance Botulinumtoxin Type A (exclusively Abobotulinum), ATC M03AX21, DAK-Gesundheit intends to conclude pharmaceutical discount contracts with as many interested pharmaceutical companies as possible until the entry into force of new pharmaceutical discount contracts. A discount contract pursuant to the licensing model for the above-mentioned substance comes into force for the first time on 01.12.2026 and expires on 30.11.2028. It expires automatically with the entry into force of the exclusive contract, regardless.
