The subject of the contract is the liquidation of illegal waste dumps located on properties belonging to the State Treasury's Agricultural Property Fund in the Lower Silesian Voivodeship. The contract has been divided into 8 separate contract subjects. The contract subjects cannot be divided by the Contractors, and offers not containing the full scope of the contract subject specified in the partial task will be rejected. The scope of work includes, among others: a) Sorting (segregation) of waste, b) Loading of segregated waste onto vehicles, c) Transport of waste to its collection or processing site, d) In the case of hazardous waste, transfer to the final recovery process or final neutralization process by the waste owner conducting such a process, e) Reclamation of the site after completion of work, f) Marking the site by installing informational signs prohibiting waste disposal. Additional obligations of the Contractor: a) taking over the illegal dump site. Upon taking over the site, the Contractor becomes the owner and producer of the waste. b) immediate commencement of the contract subject, c) development of the taken-over site at its own cost, d) performance of work in a manner ensuring the protection of the natural environment, fire safety, and safety and health at work, e) written notification to the Contracting Authority of the planned final acceptance with at least 7 days' notice, f) submission to the Contracting Authority of proof of waste transfer to an entity that has the appropriate permit for recovery and disposal of waste. If the Contractor manages waste in its own facility, proof of waste transfer may be a weigh ticket or a statement of acceptance of waste for own needs. A detailed description and scope of the service in the individual contract subjects are contained in Annex 1 to the contract "Detailed Description and Scope of the Contract". The Contractor is obliged to perform the entire contract in accordance with: a) Act of 14 December 2012 on Waste, b) Regulation of the Minister of Economy of 13 December 2010 on requirements for the use of products containing asbestos and the use and cleaning of installations or equipment in which products containing asbestos were or are used, c) Regulation of the Minister of Economy, Labour and Social Policy of 2 April 2004 on methods and conditions for the safe use and removal of products containing asbestos, d) Regulation of the Minister of Economy, Labour of 14 October 2005 on safety and hygiene rules for securing and removing products containing asbestos and the training programme for the safe use of such products, e) Other applicable regulations not mentioned above within the scope covered by the contract. Before submitting offers, the Contracting Authority recommends conducting a local inspection of the properties covered by the contract. Other conditions for the implementation of the contract are contained in the draft contractual provisions, which will be incorporated into the contract as Annex 8 to the SWZ. Submission of an offer is equivalent to acceptance of the draft contractual provisions, which will be incorporated into the contract. In Annex 1 to the contract "Detailed Description and Scope of the Contract" and the draft contractual provisions, constituting Annex 8 to the SWZ, the quality requirements relating to all contract subjects are indicated, including a detailed description of the dump site, a description of the quantity and quality of the accumulated waste (together with a situational plan specifying the location/locations of waste disposal), a detailed classification of the accumulated waste together with its disposal method and codes, a detailed scope of work regarding the planned investment together with the costs of liquidation and all other important information affecting the implementation of the individual contract subjects. The Contracting Authority does not allow the submission of variant offers. The Contractor may submit an offer for all parts of the contract. The maximum contract implementation period is: - subject 1 - 30 calendar days from the date of transfer of the site to the Contractor, - subjects 2-8 - 20 calendar days from the date of transfer of the site to the Contractor. The contract execution period is one of the criteria for selecting an offer, in which the Contractor may obtain a maximum of 10 points for shortening the maximum period – in accordance with the rules indicated in clause 19.3 of the SWZ. The Contracting Authority reserves the right to impose contractual penalties for the execution of the contract subject within a longer period than offered.
