4.1. The subject of the contract is the repair of hard-surface roads in the City of Łódź in the years 2027-2028, divided into 3 regions: Part I - Region I - the area of the Łódź Bałuty district; Part II - Region II - the areas of the Widzew and Górna districts; Part III - Region III - the areas of the Śródmieście and Polesie districts. 4.2. The contract has been divided into parts. The contracting authority does not allow the Contractor to submit offers for more than one part of the contract. 4.3. A detailed description of the subject of the contract is provided in Annex No. 1 to the SWZ, the Technical Specification for the Execution and Acceptance of Construction Works, and in the contract template which is Annex No. 7 to the SWZ (one template for all parts of the procedure). REQUIREMENTS IN THE SCOPE OF EMPLOYMENT BASED ON AN EMPLOYMENT RELATIONSHIP, IN THE LOCALITIES REFERRED TO IN ART. 95 OF THE PZP, IF THE CONTRACTING AUTHORITY PROVIDES SUCH REQUIREMENTS 33.1. Based on art. 95 para. 1 of the Pzp, the contracting authority requires employment (for each part separately) by the Contractor or Subcontractor based on an employment relationship of persons performing the activities indicated by the contracting authority in the scope of the contract implementation, if the performance of these activities consists of performing work in the manner specified in art. 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277), i.e. persons performing during the implementation of the contract works in the scope of: a) frezer operator; b) roller or vibratory plate operator; c) asphalt distributor operator; d) bituminous mass layer operator; e) rubber roller operator; f) steel roller operator, g) road repairer 23.1. The contracting authority requires the Contractor to provide a bid bond in the amount of: For Part 1: 83 000,00 PLN (in words: eighty-three thousand złotys 00/100). For Part 2: 97 000,00 PLN (in words: ninety-seven thousand złotys 00/100). For Part 3: 80 000,00 PLN (in words: eighty thousand złotys 00/100). 24.1. The Contractor whose offer has been selected is obligated to provide a performance bond in the amount of 5% of the total gross price indicated in the offer for the given part of the contract. 27. INFORMATION ON FORESEEN CONTRACTS, REFERRED TO IN ART. 214 PARA. 1 POINTS 7 AND 8 OF THE PZP, IF THE CONTRACTING AUTHORITY FORESEES THE AWARD OF SUCH CONTRACTS 27.1. The contracting authority foresees for each part of the contract the use of the right to award the current Contractor a contract consisting of the repetition of similar services in the manner provided for in art. 214 para. 1 point 7 of the Act of 11 September 2019, Public Procurement Law. The possibility of awarding a contract consisting of the repetition of similar services or works on the terms of the Agreement with the Contractor, up to the amount: in Part 1: 8 388 625,00 zł net plus the applicable VAT; - in Part 2: 9 755 880,00 zł net plus the applicable VAT; - in Part 3: 8 129 820,00 zł net plus the applicable VAT. 16.8. In accordance with art. 257 of the Pzp, the contracting authority does not foresee the invalidation of the subject of the procedure, if the public funds which the contracting authority intended to allocate for the financing of the whole or part of the contract have not been granted to it. 9.7. Information regarding certification: 9.7.1. Obtaining certification of public procurement contractors and using the certificate is voluntary. The contracting authority does not require possession of a certificate as a condition for applying for the award of a contract. 9.7.2. The Contractor may, pursuant to art. 124 para. 2 of the Public Procurement Law, instead of the appropriate personal evidentiary means, submit a certificate confirming the certification of public procurement contractors in the scope of not being subject to exclusion or the Contractor's ability to properly perform the contract. 9.7.3. The certificate replaces personal evidentiary means only to the extent that it confirms the grounds for exclusion or the conditions for participation in the procedure required by the contracting authority. 9.7.4. If the certificate does not cover all the grounds for exclusion or conditions for participation required in this procedure, the Contractor proves the remaining circumstances using personal evidentiary means indicated in the SWZ. 9.7.5. The contracting authority does not require personal evidentiary means in the scope covered by a valid certificate, with the reservation of art. 124 para. 4 of the Pzp, art. 31 para. 6 of the Act on the Certification of Public Procurement Contractors and circumstances not covered by the statutory scope of certification. 9.7.6. The certificate does not replace the declaration referred to in art. 125 para. 1 of the Pzp, including the European Single Procurement Document, nor declarations and documents required in the scope of the grounds for sanctions resulting from art. 7 of the Act on Counteracting the Support of Aggression against Ukraine and Council Regulation (EU) No 833/2014. 9.7.7.
