The municipality of Breitenbach am Herzberg (hereinafter "Granting Authority") aims to establish comprehensive, high-performance access to Gigabit networks. Furthermore, the Granting Authority aims to strengthen its economic location and ensure the competitiveness of its companies. Therefore, a concession contract for the construction and operation of Gigabit networks as well as the provision of end-customer services in the relevant areas is to be concluded with a telecommunications company. For this purpose, the Granting Authority has submitted a funding application within the framework of the federal funding programme "Support for the promotion of the gigabit expansion of telecommunications networks in the Federal Republic of Germany - Gigabit Guideline 2.0", 2nd amendment of 13.01.2025, within the framework of the "Gap Closure Programme" in the sense of No. 9.1 and has been granted funding. In addition, the Granting Authority has applied for co-financing under the "Guideline for the promotion of gigabit supply in the State of Hesse" and has also been granted funding. The funding generally covers the specified investment costs. The investment costs are determined from the net present value of all revenues for a period of at least seven years and the net present value of all costs of network construction. Funding for operating costs (including operating costs, financing costs and costs for pre-products) is not provided. Within the framework of the federal funding, financing costs are generally eligible for funding if they serve the (interim) financing of the material costs incurred for the construction of the funded network. These include, for example, costs for construction interest. According to the grant notice of the State, financing costs are not eligible for funding. Therefore, it is pointed out that there is a risk that these will not be paid out by the State at the later drawdown of funds if financing costs are shown in the economic viability gap calculation. In this case, the financing costs would have to be borne by the concessionaire themselves. Accordingly, the economic viability gap to be stated under Section 3.1 of the grant contract to be concluded would then be reduced. An increase in the maximum grant amount named in the grant notice is not possible. Offers with a result (economic viability gap or total financing) of more than 1 million EUR (net) cannot be taken into account within the framework of the offer evaluation. The conclusion of the grant contract (see Annex 4 to the specification of services and Section D. V. 10 of the accompanying document to the notice) is subject to the condition that the corresponding own contributions of the Granting Authority can be made available in accordance with budgetary law.
