Poland – Explosives – Dostawa sprzętu i pomocniczych środków strzałowych dla Oddziałów Polskiej Grupy Górniczej S.A. – nr grupy 246-12

1. The subject of the contract is: Supply of equipment and auxiliary ammunition for the Units of Polska Grupa Górnicza S.A. – group number 246-12.

2. CPV code: 24600000

3. A detailed description of the subject of the contract, as well as the legal requirements and technical specifications, are set out in Annex No. 1 to the Contract Notice. The quantity range of the subject of the contract is the estimated range specified by the Contracting Authority with due care. The Contracting Authority, despite exercising due care, does not guarantee the full execution of the contract due to the nature of the activity carried out.

4. In order to confirm that the offered service is in accordance with the requirements of the Contracting Authority, it is necessary to submit, together with the offer, the relevant evidential means.

5. The Contracting Authority does not allow the possibility of submitting variant offers.

6. The Contracting Authority reserves the right to change the quantity of goods ordered within the framework of individual assortment positions and to place orders according to actual needs, with the reservation that the total value of deliveries will not exceed the value of the contract.

7. The Contracting Authority declares that the minimum guaranteed level of contract performance is 50% of the value of the order placed. Contractors are not entitled to claims for contract performance to a greater extent.

8. The procedure for awarding the sectoral contract is conducted in the open procedure in accordance with the provisions of the Act of 11 September 2019 on Public Procurement (i.e. Journal of Laws 2024 item 1320 as amended), hereinafter referred to as the Pzp Act.

9. The procedure is conducted in the Polish language.

10. The information obligation arising from Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 2016.119.1 of 4 May 2016) (hereinafter: "GDPR") has been fulfilled on the PGG S.A. website in the GDPR tab, in the annex "Contractors/Contractors' Employees". In the case of processing personal data for a purpose related to the public procurement procedure, the Contracting Authority has fulfilled the information obligation in the Buyer's Profile on the Polska Grupa Górnicza website in the "Public Procurement Information Obligation" tab.

11. Additionally, the Contracting Authority informs that a) the exercise by the data subject of the right to rectification or completion, referred to in Article 16 of the GDPR, cannot result in a change in the outcome of the public procurement procedure or a change in the provisions of the public procurement contract that are inconsistent with the law. b) in the public procurement procedure, the submission of a request to restrict processing, referred to in Article 18(1) of the GDPR, does not restrict the processing of personal data until the end of this procedure.

12. The Contracting Authority allows the possibility of submitting partial offers for individual parts of the contract (tasks) specified in Annex No. 2 to the Contract Notice. The submitted offer must cover the entire scope and quantity of the part of the contract. The number of contract parts (tasks) is: 12.

13. The Contracting Authority envisages the possibility of submitting an offer by one Contractor for one or more parts of the contract (tasks).
