Description
1. The subject of the contract is the "Supply of a Specialised Service Vehicle with Equipment for the Municipal Guard of the City of Krakow", ST.RL.261.20.2026. 2. As part of the contract, the Contractor will supply one vehicle, hereinafter also referred to as the vehicle in accordance with the Subject of the Contract Description (SOD) specified in Annex 2 to the SWZ, the equipment of which consists of: a) A vehicle serving as a command and drone operation center; b) Drone (BSP) class C1; c) Drone (BSP) class C2; d) Computer equipment; e) Other equipment. 3. The Contractor provides a full warranty for the vehicle and equipment components on the terms specified in the contract documents, in particular in the draft contract terms (DCT) - contract template, constituting Annex 8 to the SWZ and in accordance with the submitted offer. 4. A detailed description of the subject of the contract and the scope of the Contractor's obligations is specified in the annexes to the SWZ, including in the Draft Contract Terms and in the Subject of the Contract Description - SOD. 5. The Contracting Authority, in accordance with Article 139(1) of the Pzp Act, provides for a reversed sequence of actions, i.e. first conducts an examination and evaluation of offers, and then qualifies the Contractor whose offer was highest-rated, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. Due to the application of the above procedure, the Contracting Authority does not require the submission of a declaration in the form of the Single European Procurement Document (SEPD) with the offer. The Contracting Authority requires the submission of this declaration exclusively from the Contractor whose offer was highest-rated. 6. The offer must include the following declarations and documents: a) Offer form (with required annexes) and Technical Specification of the subject of the contract – by placing on the Platform the completed Annex 1 and 1a to the SWZ prepared according to the template provided by the Contracting Authority. In the event of submitting an offer on a form other than Annex 1 and 1a to the SWZ, it should contain all the required information specified in this annex. The offer form and the Technical Specification of the subject of the contract are not subject to supplementation. b) In the case of Contractors referring to the resources of entities providing resources – Commitment of these entities using the template constituting Annex 7 to the SWZ. c) In the case of Contractors jointly applying for the award of the contract – Declaration under Article 117(4) of the Pzp Act using the template constituting Annex 4 to the SWZ. d) Copy or information from the National Court Register, Central Register and Information on Business Activity or another appropriate register – in order to confirm that the person acting on behalf of the Contractor is authorised to represent it. The Contractor is not obliged to submit the above documents, if in the Offer Form it indicates data enabling access to these documents through free and publicly available databases. e) If applicable – Powers of Attorney. 7. The documents referred to in point 6 lit. a-e above, the Contractor is obliged to submit via the Platform. 8. The Contractor submits only one offer in accordance with the requirements specified in the SWZ. The content of the offer must correspond to the content of the SWZ. 9. The Contractor may confirm the absence of grounds for exclusion from the procedure and the fulfilment of the conditions for participation in the procedure by means of a Contractor Certificate, referred to in the Act of 5 August 2025 on the certification of public procurement contractors and amending certain other acts. This certificate must have a current validity status on the date of its submission. The use of the Contractor Certificate is voluntary and constitutes an alternative to the submission of subject-specific evidence on the general principles specified in this SWZ. 10. If the Contractor intends to rely on the certificate referred to in point 3 above, in order to demonstrate the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure, it is obliged to indicate in the content of the declaration referred to in Article 125(1) of the Pzp Act, the data identifying this certificate, in particular: - the number and unique identifier of the certificate, - the full name of the certifying entity that issued the document, - the validity period of the certificate, - the exact scope of the grounds for exclusion or the conditions for participation, in relation to which the Contractor uses this certificate. 11. In accordance with Article 124(2) of the Pzp Act, the Contractor may submit a current certificate issued by an accredited certifying entity instead of the appropriate subject-specific evidence, provided that this certificate confirms the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure in the scope required by the Contracting Authority in this procedure. 12. In the event that the submitted certificate does not cover the full scope of the requirements specified by the Contracting Authority (e.g. does not confirm all the optional grounds for exclusion indicated in the SWZ), the Contractor is obliged to submit the missing subject-specific evidence together with the certificate on the general principles specified in the SWZ. 13. To the extent that a current and valid Contractor Certificate confirms the absence of grounds for exclusion from the procedure or the fulfilment of the conditions for participation in the procedure, the contractor is exempt from the obligation to submit the appropriate subject-specific evidence. 14. If the Contractor Certificate does not cover the full scope of the requirements specified by the Contracting Authority in this SWZ, the contractor is obliged to present the Certificate and supplement it with the missing subject-specific evidence on general principles.
