Poland – Credit granting services – Udzielenie kredytu długoterminowego w kwocie 3 407 368,00 zł

The subject of the contract is the provision of a long-term złoty loan in the amount of 3 407 368.00 PLN for the Municipality of Lubaczów, hereinafter referred to as the Contracting Authority, with the following characteristics: a) Loan amount 3 407 368.00 PLN (in words: three million four hundred and seven thousand three hundred and sixty-eight złotys 00/100). The loan will be disbursed in Polish złoty (PLN), in a non-cash form through the realization of the Contracting Authority's dispositions. b) Purpose of the loan: • repayment of previously incurred liabilities under loans and advances in the amount of 1 964 088.00 PLN, • financing the planned deficit in the amount of 1 443 280.00 PLN. c) Loan period: from the date of signing the contract until 31.12.2038. d) The repayment of the loan will be secured exclusively by a blank promissory note together with a promissory note declaration, with the countersignature of the Municipality's Treasurer on these documents. 3.1. The Detailed Description of the Subject of the Contract (SOPZ) constituting Annex No. 1 to this specification 3.2. The projected provisions of the contract regarding the public contract constitute Annex No. 7. The projected provisions of the contract regarding the public contract, which will be incorporated into the contract. 1. The contract regarding the public contract, in accordance with the projected contract provisions attached to the SWZ, will be concluded with the Contractor, whose offer was selected as the most advantageous. The contract conclusion date will be provided by the Contracting Authority. 2. The possibilities of changing the concluded contract and the conditions of such changes have been specified in the projected contract provisions regarding the public contract. Description of the method of preparing the offer. 1. The Contractor may submit one offer. 2. The offer must meet the following requirements: a) it must be prepared in Polish in electronic form in a data format consistent with the formats specified in the regulation of the President of the Council of Ministers of 30 December 2020 on the method of preparing and transmitting information and technical requirements for electronic documents and electronic communication means in the proceedings for awarding a public contract or tender – it is recommended to prepare the offer in .doc, .docx, .pdf formats. The offer should be submitted, under pain of invalidity, in electronic form, i.e., in electronic form with a qualified electronic signature by the authorised person/people. By the authorised person/people is meant: b) a person/people who, in accordance with the relevant provisions, is/are authorised to make declarations of will in the scope of the Contractor's property rights and obligations; c) the Contractor's proxy/ies, to whom the authorisation was granted by the person/people referred to in lit. a); d) a proxy appointed by the Contractors jointly applying for the award of the contract. e) documents and/or declarations prepared in a foreign language must be submitted together with their translation into Polish. 3. The Contractor may change the graphic form of the templates of the annexes to the SWZ and other forms of the Contracting Authority, however, the content contained in the Contracting Authority's templates may not be changed. 4. The Contractor may submit only one offer. Offers should be submitted, under pain of invalidity, in electronic form. 5. The content of the offer must correspond to the content of the SWZ. 6. The offer is prepared in Polish on the Offer Form - in accordance with Annex No. 2 to the SWZ 7. The offer must include: 1) the completed OFFER form - must be submitted in electronic form, i.e.: transmitted in electronic form and marked with a qualified electronic signature; 2) the completed JEDZ for the Contractor and the resource-providing entity - must be submitted in electronic form, i.e.: transmitted in electronic form and marked with a qualified electronic signature; 3) the commitment of the resource-providing entity or other document (if applicable) – must be submitted in electronic form, i.e.: transmitted in electronic form and marked with a qualified electronic signature; 4) a declaration of non-exclusion regarding the exclusion grounds from art. 5k of regulation 833/2014, 5) a declaration of non-exclusion regarding the exclusion grounds from art. 5k of regulation 833/2014 - a declaration of the resource-providing entity, if applicable (if applicable), 6) document/s confirming the authorisation to represent the Contractor and/or the resource-providing entity in order to confirm that the person acting on behalf of the Contractor and/or the resource-providing entity is authorised to represent it: a) a copy or information from the National Court Register or from the Central Information and Registration System for Business Activity or from another appropriate register. The Contractor is not obliged to submit the above documents if the Contracting Authority can obtain them through free and publicly available databases, provided that the Contractor and/or the resource-providing entity indicates the data enabling access to these documents (in the OFFER form and/or the resource-providing entity's commitment printout) and with the reservation of ppkt. b) b) if the person acting on behalf of the Contractor and/or the resource-providing entity is a person whose authorisation to represent it does not result from the documents referred to in ppkt. a), the Contracting Authority requires the Contractor to provide a power of attorney or other document confirming the authorisation to represent the Contractor and/or the resource-providing entity, c) power of attorney – if required to represent the Contractor/s in the case of: - the Contractor is represented by a proxy, - the offer is submitted by Contractors jointly applying for the award of a public contract with the content required by art. 58 sec. 2 Pzp (also applies to partners of a civil partnership), - the authorisation does not result from ppkt 7 a) and b) must be submitted in electronic form, i.e.: transmitted in electronic form and marked with a qualified electronic signature More information in the SWZ
