The subject of the contract is the design, production, and delivery of multi-unit, passenger rail vehicles with alternative, emission-free propulsion, equipped with a pantograph and serving non-electrified railway lines as part of an Innovative Partnership. The contracting authority envisages: 1) within the framework of research and development work, the creation and testing of a prototype of the Vehicles in two units. The contracting authority requires one Partner to create one solution/prototype design in two units. 2) within the framework of deliveries following the research and development phase: the delivery of two vehicles with the right of option, as referred to in Article 441 of the Public Procurement Law, i.e. the delivery of a maximum of twelve additional units of the Vehicles. 2. A detailed description of the subject of the contract is included in the Description of Needs and Requirements (DNR) and in Annexes 1a and 1b to the DNR. 3. The procedure is conducted in the Polish language using electronic communication means, i.e. via the Procurement Platform (hereinafter: the Platform) at https://kd.eb2b.com.pl. The use of the Procurement Platform is free of charge. All declarations, notifications, explanations, and other documents in the subject matter of the procedure, as well as the contract, are drawn up in the Polish language. 4. The address of the website where changes and explanations of the DNR content and other documents of the contract directly related to the subject matter of the procedure will be made available: https://kd.eb2b.com.pl. 5. The contracting authority informs that it conducted Preliminary Market Consultations (hereinafter: PMC) regarding multi-unit passenger vehicles with their own alternative propulsion from 03.06.2025 to 30.11.2025. The notice of the Preliminary Market Consultations was published on the contracting authority's website at https://kd.eb2b.com.pl on 03.06.2025. 5.1. Participation in the Preliminary Market Consultations is considered to be engagement in the preparation of the public procurement procedure, therefore, Contractors who participated in the Preliminary Market Consultations are obliged to take this fact into account when completing the EDR. 6. The contracting authority envisages the possibility of establishing an Innovative Partnership with a maximum of 2 (two) Partners.
