Poland – Refuse and waste related services – Odbiór i zagospodarowanie (w procesie R3) odpadów o kodzie 16 01 03 (zużyte opony)

The subject of the tender is the service of collection and disposal of waste with code 16 01 03 (used tyres) in a manner that ensures the transfer of responsibility for waste management to the next waste holder. 2. The collected waste will be entirely subjected to the R3 process. 3. The quantity of waste covered by the tender is up to 1250 Mg, including 600 Mg in the basic tender - car and truck tyres and up to 600 Mg in the option car and truck tyres and up to 50 Mg agricultural tyres and other diagonal tyres. The right to the option has been defined in art. 441, section 1 of the PZP Act. The Buyer may use the option in full or in part, once or in several parts. An option relating to the increase in the quantity of waste intended for collection and disposal is envisaged. 4. The Contractor will collect the above waste from the Buyer's facilities: 1) Waste Treatment Plant in Olsztyn (ul. Piotra Poleskiego 3, 10-410 Olsztyn) – approx. 62% of the volume covered by the tender, 2) Transfer Station Polska Wieś (Polska Wieś 24, 11-700 Mrągowo) – approx. 10% of the volume covered by the tender, 3) Transfer Station Medyny (Medyny 51, 11-100 Lidzbark Warmiński) - approx. 12% of the volume covered by the tender, 4) Transfer Station Trelkowo (Trelkowo 80, 12-100 Szczytno) – approx. 14% of the volume covered by the tender. 5) Transfer Station in Pisz (ul. Olsztyńska 3, 12-200 Pisz) - approx. 2% of the volume covered by the tender (based on the agreement Stację przeładunkową mpd 0002/000148977 on behalf of ZGOK in Olsztyn is operated by the company PWIK PISZ) The estimated volumes have been determined based on historical data, the percentage share of tyres in individual facilities may change. 5. Due to the subject of the tender, it must be implemented, in particular, in accordance with the following regulations: 1) Act of 14 December 2012 on waste; 2) Act of 27 April 2001 on Environmental Protection Law; 3) Act of 13 September 1996 on maintaining cleanliness and order in municipalities and other acts and regulations applicable to the subject of the tender. 6. The waste collected from the Buyer will be transferred to an entity holding a decision specified in art. 27, section 2, point 1 or 2 of the Act of 14 December 2012 on waste indicated by the Contractor before signing the contract. 7. For the settlement between the Parties, the quantity of waste collected will be determined according to the measurement on the Buyer's electronic vehicle scale. 8. The transfer of waste will be confirmed by a waste transfer note – in accordance with the applicable regulations. 9. In accordance with art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, it is prohibited to carry out a public procurement contract with the participation of subcontractors, suppliers or entities, on whose capacity it depends in the sense of Directive 2014/24/EU, in the event that it falls on them more than 10% of the value of the contract. 10. The detailed description of the subject of the tender and the conditions of cooperation have been described in Annex No. 3 to the SWZ entitled Projected Contract Terms.
